RESOLUTION NO.
A RESOLUTION RESCINDING THE AWARD OF A CON-
TRACT TO AERO PRODUCTS, INC. FOR FURNISHING
THREE CUSTOM RESCUE AMBULANCES FOR THE DEPART-
MENT OF FIRE; REJECTING ALL OTHER BIDS; DIR-
ECTING THE CITY MANAGER AND THE PURCHASING
AGENT TO READVERTISE FOR THE ACQUISITION OF
SAID EQUIPMENT.
11HEREAS, the City has determined a need for emergency
rescue vehicles to replace worn out and obsolete in service
units; and
WHEREAS, the City, pursuant to Resolution No. 80-605,
passed and adopted the 24th day of July, 1980, has awarded a
Contract and Purchase Order to Aero Products, Inc.; and
WHEREAS, Aero Products, Inc. had, at the time of bidding,
applied for a motor vehicle dealer's license with the State of
Florida, but such license was not issued until July 14,
1980; and
WHEREAS, the general conditions of the City of Miami's
Invitation to Bid required compliance with all federal, state,
county and city laws; and
WHEREAS, Aero Products, Inc. did not have the necessary
license to deal with motor vehicles as of the date of the
opening of bids, and to award a purchase order under these
conditions would violate competitive bidding requirements and
give an unfair advantage to Aero Products, Inc.; and
WHEREAS, the Invitation for Bids provided that the bids
would be valid for a period of ninety (90) days after the
opening of the bids, which was July 8, 1980;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution 80-605, adopted July 24, 1980,
accepting the bid of Aero Products, Inc. for furnishing three

Custom rescue ambulances for the Department of Fire is hereby
rescinded, and all bids received under the Invitation for Bids,
Bid No. 79-80-77 are hereby rejected; the City Manager is also
hereby instructed to have the Purchasing Agent readvertise and
to issue Invitations t_o Bids for said rescue vehicles.

Pursuant to a request for investigation, the Law Department
issued a Legal Opinion dated August 14, 1980, tiIA-80-45, dealing
with the submission of the bid by Aero Products, Inc., pursuant
to Instructions to Bidders, Bid No. 79-80-77, which resulted in
the award of a bid to Aero Products, Inc. on July 24, 1980. The
attached Legal Opinions indicate that the Aero Products, Inc., as
of the date of bid openings, was technically not in compliance
with state law regarding licenses and did not receive a license
dealing with motor vehicles until six days after the opening of
the bids. It now appears that Aero Products, Inc. is in compli-
ance with state law, and therefore, is not in violation of Gen-
eral Condition No. 19. It appears, however, from the Legal
- Opinion from the Law Department that the key time for obtaining a
license was as of July 8, 1980, and the date of the submission of
bids, and if Aero Products, Inc. was not in compliance, there
would have been an unfair advantage and the comparative character
would have been destroyed at the bidding. Supplemental Legal
Opinion issued by the Law Department dated November 5, 1980, in-
dicates that Aero Products, Inc. was given an opportunity to
submit substantiation as to the aspects of the award, and that
its attorney has agreed that a rebidding would be in the best
interest of the parties. Such rebidding would prevent the possi-
bility of a taxpayer action or of a disgruntled bidder's lawsuit
if the City had continued to award the Contract where it appears
General condition No. 19 was not met.
The requirement of complying with all legal requirements is
not an irregularity that could be waived at the time of bidding,
even though the bidder later complied. Due to the time factor
involved of more than ninety days after the original call for
bids, it is necessary to reject all bids and to begin the ac-
quisition process once again by readvertising. To accomplish
this, the City Commission should rescind its previous award by
the accompanying Resolution, which also rejects all other bids
and directs readvertisement for new bids.

Additionally, it is the Law Department's opinion that all
competitors should be allowed to compete on an equal basis and
that Aero Products, Inc. should be permitted to compete in, the
renewed process, as well as any other competitors who may wish
to bid.

ENCLOSURES Tabulation of Bid
Enclosed is the Tabulation of Bid for three (3) Rescue Ambulance
Vehicles and the optional related equipment. I am recommending
the Award of Bid to Aero Product, Inc., 160 C Hope Street, P.O.
Box 1505, Longwood, Florida, 32750, for a total contract price of
$149,728.05. This company Meets all specifications and special
conditions and is low bidder by $17,206.95.
We are surprised that only two companies chose to bid on these
specifications since they are not restrictive in anv manner.
Although proposals were mailed to 12 different companies, three
are distributors for three of the manufacturers that are included

four of these nine submit bid proposals to the City of

tion specifications and encouraged to bid since they had not responded
to our past bid requests. EVF, Inc. (Custom A;7`-ulance Division) and
Star -Linn Enterprises, Inc. usually submit propos ls. Even with this
extra effort by the Fire Department to encourage competitive bidding,
only E%7F, Inc. , the cor;pany that received the contracts for the last
five vehicles purchased, and Aero Products submitted proposals this
time.
We require a body size that is 18 inches longer than the more cormnon
Rescue FTbulance being; purchased throughout the State. 4lthough this
in no way restricts any manufacturer from bidding co-petitively, we
believe some of them prefer not to build to custom size specifications.
I have no reservations in recommending an award of bid with only two
proposals being received. Every effort has been made to encourage
several bidders to respond.
