WHEREAS, 'the Miami Zoning Board at its meeting of
November 17, 1980, Item No. 3, following an advertised hearing
adopted Resolution No. Z�i 215-80 by a 7 to 0 vote recommending
denial of change of zoning'\.classification, as hereinafter set forth;
and
WHEREAS, the City Comc�ission notwithstanding_ the denial
of the 7.onint; Board finds that the use i;,ill not be detrimental or
injurious to the character of the d`L-velopment of the immediate
neighborhood;
NOW, THEREFORE, BE IT ORDAINEV BY THE COMMISSION OF THF.
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, tlhe Comprehensive
Zoning Ordinance for the City of Miami, be a4d the same is hereby
amended by changing the zoning classification f Loi:s 13, 14, 15 and
16; WILLIAM G. JUST (8-63), being approximately 495 northwest 18th
Terrace, from R-1 (One Familv) to R-4 (Medium Den s'ty Multiple),
and by maki.nF,, the necessary changes in the zoning diXtrict man made
a part of said Ordinance 'No. 6871, by reference and de\scription in
Article III, Section 2 thereof.. \\,
Section 2. All ordinances, code sections, or riprts
thereof in conflict herewith,

Section 3. Should any part or provision of this
Ordinance be declared by a Court of competent jurisdiction to be
invalid, the same shall not affect the validity of the Ordinance
as a whole.

Multiple Dwelling).

DENIAL. The proposed rezoning does not meet the qualifi-
cations established under Article XXX, Section 9 of the
Zoning Ordinance. There has been no significant change in
land use character of this area to justify intensifying
the zoning to the extent vrhich is being requested. A
recent study of this area she�•red that t-.'hile there has been
some construction of duplexes and single family hoimes
on vrhat mere vacant lots, the total increase in structures
in the area since 1970 has been m4nor (approximately
20 structures have been built or converted to duplexes in
the last ten yc=,:rs) . Ever; the prcposed z^ni ng for this
site under the future Cer,�prehensive Zoning Ordnance is for
P.G-1 or "one and t„o family" develc; .r�nt.
Finally, the proposed chance �•rould create an isolated
district unrelated to adjalcent districts. Uhile it is
true that this property is contiguous to R-4 zoning,
the only property which is develc,ed under the R-4 (an
196 unit condo building) is physically separated from
the subject site by I;.l;. l8th Terrace and by a portion
of the Miami River.
PUBLIC WORKS
Dedication cannot be requested for change of zoning.
D.O.T.T.
D.O.T.T. has no objection to this proposal.
ZONING BOARD Deferred on November 3, 1980.
RECOMMENDED DENIAL on November 17, 1980, by a
