AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 9179, ADOPTED OCTOBER 3, 1980, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1981, AS AMENDED; BY INCREASING THE APPROPRIATION FOR THE GENERAL FUND, POLICE DEPARTMENT IN THE AMOUNT OF $75,000; BY DECREASING THE APPROPRIATION FOR THE GENERAL FUND, SPECIAL PROGRAMS AND ACCOUNTS, PUBLIC SAFETY FUND, IN THE SAME AMOUNT; FOR THE PURPOSE OF FUNDING THE REPLACEMENT OF SEVENTY (70) POLICE VEHICLES AND THE PURCHASE OF THIRTY-THREE (33) NEW POLICE VEHICLES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9179 on October 3, 1980, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1981; and WHEREAS, the Police Department estimates that $797,776 will be re- quired to fund the replacement of seventy (70) police vehicles and the pur- chase of thirty-three (33) new police vehicles; and WHEREAS, of the aforementioned cost, $247,500 has been budgeted in the Police Department's FY 1981 Budget and $475,276 will be provided by the Department of Building and Vehicle Maintenance, for a total of $722,776; and WHEREAS, the remaining $75,000 is available in the General Fund, Special Programs and Accounts, Public Safety Fund, and can be appropriated into the Police Department's budget to purchase the aforementioned vehicles; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 9179, adopted October 3, 1980, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1981, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The following appropriations are made for the municipal operations of the City of Miami, Florida, for the fiscal year 1980-81, including the payment of principal and interest on all General Obligation Bonds: i--- -------------------------------------------------------------------------- -� Words and/or figures stricken through shall be deleted. The herein transfer of $75,000 from the General Fund, Special Programs and Accounts, Public Safety Fund, to the General Fund, Police Department is for the purpose of funding the replacement of seventy ( 70 ) police vehicles and the purchase of thirty-three (33) new police vehicles. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining pro- visions of this ordinance shall not be affected. Section 5. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two sepa- rate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. -2- 922 0 O PASSED AND ADOPTED THIS 1980. Suran�ing Director 1k Department of Ma Mt and Budget December 4, 1980 2-9179 Transfer of $75,000 from the Public Safety Fund to the Police Department for the Purchase of Police Vehicles It is recommended that a transfer of $75,000 be. made within the General Fund from Special Programs and Accounts, Public Safety Fundy to the Police Department for the purpose of funding the replace- ment of seventy (70) police vehicles and the pur- chase of thirty-three (33) new police vehicles. The Police Department estimates that $797,776 will be required to fund the replacement of seventy (70) police vehicles and the purchase of thirty-three (33) new vehicles. Of this cost, $475,276 will be provided by the Department of Building and Vehicle Maintenance and $24 7, 500 has been budgeted in the Police Department's FY 1981 budget, for a total of $722,776. When the original budget was prepared the prices were adjusted at a ten percent increase, the bids that were received show an unexpected increase which is much larger than ten percent. The seventy (70) replacement vehicles would require an additional fifty thousand dollars ($50,000.00) to purchase. Based on previous years data, this Department projected a 10% inflationary increase in vehicle costs at the time of budget preparation. Actual bids, recently received, proved said increase to be between 18 and 26 percent, as shown below: % 1979/80 Bid: Volare $5,778.00 1980/81 Bid: LeBaron 7,305.51 Price increase: 26.4% 1979/80 Bid: Grand Fury 6,.406.00 1980/81 Bid: Grand Fury 7,558.07 Price Increase: 18.0% Other factors contributing to the need for additional funding are: . 1. Police Department's request for fifteen (15) compact and fifty-five (55) full-size vehicles for this year as compared to fifty (50) compact and fifteen (15) full-size vehicles last year. 2. Police Department's request for thirty-three (33) additional vehicles. Out of the total $75,000.00 requested to be transferred, $25,000.00 is to supplement this purchase due to the price differential. 3. Police Department's request for 60/40 split seats to accommodate variations in personnel sizes. This represents an additional $197.20 per vehicle. e • 2 4. An unexpected increase -of $150.per vehicle for miscellaneous equipment to be installed in the 33 additional vehicles (electronic siren, vehicle dividers, emergency lights). As noted in the attached schedule, an additional $121,242.81 is needed to supplement the above costs for police vehicles. The Department of Building and Vehicle Maintenance will appropriate $46,242.81 out of its retained earnings for this purpose (a request to that effect is being sent to the Department of Management.and Budget). The remaining $75,000 would come out of Police Department's Contingency Fund, as explained on Chief Harms'memo of December 1, 1980.
