AN EMERGENCY ORDINANCE AMENDING SECTIONS 2 AND 5
OF ORDINANCE NO. 9179, ADOPTED OCTOBER 3, 1980,
THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL
YEAR ENDING SEPTEMBER 30, 1981; BY APPROPRIATING
FROM THE BUILDING AND VEHICLE MAINTENANCE DEPART-
MENT, MOTOR POOL MAINTENANCE DIVISION, FY '80
RETAINED EARNINGS, AN AMOUNT OF $46,250; IN-
CREASING ANTICIPATED REVENUES IN THE SAME AMOUNT
TO BE APPROPRIATED INTO THE MOTOR POOL MAINTENANCE
DIVISION TO PROVIDE SUPPLEMENTARY FUNDING FOR THE
PURCHASE OF MOTOR POOL REPLACEMENT VEHICLES;
CONTAINING A REPEALER PROVISION AND A SEVERA-
BILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9179 on October
3, 1980, establishing revenues and appropriations for the City of Miami,
Florida, for the fiscal year ending September 30, 1981; and
WHEREAS, the Department of Building and Vehicle Maintenance esti-
mates that a total of $804,250 will be required from the Motor Pool
Maintenance Division to fund motor vehicle replacement; and
WHEREAS, $758,000 is currently available in the Motor Pool
Maintenance Division budget for the aforementioned purpose; and
WHEREAS, an additional $46,250 is needed to meet the total require-
ment of $804,250 for the motor vehicle replacement and is available from the
Motor Pool Maintenance Division, FY '80 Retained Earnings;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI , FLORIDA:
Section 1. Sections 2 and 5 of Ordinance No. 9179, adopted October
3, 1980, the Annual Appropriations Ordinance for the fiscal year ending
September 30, 1981, are hereby amended in the following particulars: 1/

1/ Words and/or figures stricken through shall be deleted. Underscored words
and/or figures constitute the amendment proposed. The remaining provisions
are now in effect and remain unchanged. Asterisks indicate omitted and un-
changed material. All figures are rounded to the next dollar.
"Section 2. The following activities, which are
carried on for the service and convenience of
other funds, shall be operated by the City Manager
within the limits of the appropriations provided
in the foregoing departments, boards, offices, and
accounts of the City of Miami and other revenues
or receipts which may be received:

Section 5. The above appropriations are made
based on the following sources of revenues for the
1980-81 fiscal year:

Section 2. An amount of $46,250 from the Building and Vehicle
Maintenance Department, Motor Pool Division, FY '80 Retained Earnings is
hereby appropriated into the Motor Pool Maintenance Division for the purpose
of funding the purchase of Motor Pool replacement vehicles.
Section 3. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining pro-
visions of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further ground
of the necessity to make the required and necessary payments to its employees
and officers, payment of its contracts, payment of interest and principal on
its debts, necessary and required purchases of goods and supplies, and to
generally carry on the functions and duties of its municipal affairs.
Section 6. The requirement of reading this ordinance on two sepa-
rate days is hereby dispensed with by a vote of not less than four -fifths of
the members of the Commission.

Appropriation of $46,250 from Motor
Pool Maintenance Retained Earnings
for Vehicle Replacement

It is recommended that an appropriation of $46,250
be made for the Motor Pool Maintenance Division of
Building and Vehicle Maintenance— from the Motor
Pool Maintenance Division, FY 180 Retained
Earnings, to supplement the funding for motor
vehicle replacement.
It is estimated by the Department of Building and Vehicle Maintenance that
a total of $804,250 will be required to fund the aforementioned motor
vehicle replacement. Inasmuch as an amount of $758,000 has been budgeted
for the Motor Pool Maintenance Division, an additional $46,250 is needed to
meet the total requirement. This amount is available from the Motor Pool
Maintenance Division, FY `80 Retained Earnings, and can be appropriated for
the above mentioned purpose.
The attached proposed ordinance has been prepared as an emergency for the
December 17, 1980 City Commission meeting in order to expedite the
replacement of motor vehicles.

This is a recommendation for the purchase of automobiles and one wrecker
identified in Bid #80-81-07, received November 18, 1980.
This recommendation requests 124 replacement vehicles urgently needed to
maintain an established replacement schedule of seven years or 70,000
miles. All vehicles are in poor condition and have attained established
replacement criteria. -
Item I - Thirty-three new and additional police pursuit vehicles are in-
cluded in this recommendation at the request of the Police Department to
provide additional police units.
