AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE
COMPREHENSIVE ZONING ORDINANCE FOR THE CITY
OF MIAMI, BY CHANGING THE ZONING OF E100' OF -
N41/4 LESS S153' AND LESS E100' OF LOT 10, —
BLOCK 2; EDWARD PENT HOMESTEAD (A-45), BEING
APPROXIMATELY 2956 BIRD AVENUE, FROM R-2
(TWO FAMILY) TO R-3A (LOW DENSITY APARTMENT), —_
AND BY MAKING ALL THE NECESSARY CHANGES IN THE
ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE
NO. 6871, BY REFERENCE AND DESCRIPTION IN
ARTICLE III, SECTION 2, THEREOF; BY REPEALING
ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF
IN CONFLICT AND CONTAINING A SEVERABILITY
CLAUSE.
WHEREAS, the Miami Zoning Board at its meeting of.
September 8, 1980, Item No. 12, following; an advertised hearing,
adopted Resolution No. ZB 172-80 by a 6 to 0 vote (1 member
absent) recommending a change of zoning classification as hereinafter
set forth; and
WHEREAS, the City Commission after careful consideration
of this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth; -
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive
Zoning Ordinance for the City of Miami, be and the same is hereby
amended by changing the zoning classification of E100' of NW1/4 less
S153' and less E100' of Lot 10, Block 2; EDWARD PENT HOMESTEAD
(A-45), being approximately 2956 Bird Avenue, from R-2 (Two Family)
to R-3A (Low Density Apartment) district, and by making the necessary
changes in the zoning district map made a part of said Ordinance
No. 6871, by reference and description in Article III, Section 2,
thereof.
Section 2. All ordinances, code sections, or parts
thereof in conflict herewith, insofar as they are in conflict, are
herewith repealed.
Section 3. Should any part or provision of this _
Ordinance be declared by a Court of competenet jurisdiction to be
invalid, the same shall not affect the validity of the Ordinance as
a whole.
