AN EMERGENCY ORDINANCE AMENDING SECTIONS 35-91, 35-92, AND
35-93 OF THE CODE OF THE CITY OF MIAMI, FLORIDA (1980), AS
AMENDED, ESTABLISHING RATES AT CERTAIN ON -STREET PARKING
METERS AND CERTAIN OFF-STREET PARKING LOTS AND DELETING FROM
SAID RATE SCHEDULE CERTAIN OF SAID LOTS NO LONGER IN OPERATION;
ESTABLISHING RATES AT MUNICI$AL PARKING GARAGES AND DELETING
PARKING GARAGE NO. 2 (WHICH IS NO LONGER IN OPERATION) FROM
SAID RATE SCHEDULE; PROVIDING FOR THE EFFECTIVE DATE OF
JANUARY 1, 1981 FOR SAID RATES; RATIFYING AND CONFIRMING ALL
ACTS OF THE OFF-STREET PARKING BOARD AND ITS DIRECTOR AS TO
RATES HERETOFORE CHARGED; FURTHER PROVIDING THAT THE DIRECTOR
SHALL CAUSE CERTIFIED COPIES TO BE FILED PURSUANT TO SECTION
503 OF THE TRUST INDENTURE; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the Off -Street Parking Board of the City of Miami,
on December 3, 1980, instructed the Director to submit an ordinance to the
City Commission, upon recommendation of the Parking Consultant, that parking
rates be increased in certain on -street parking areas, in certain off-street
parking lots and that rates be increased at the Municipal Parking Garages;
and
WHEREAS, the Parking Consultant has personally inspected the
parking facilities and carefully reviewed the existing rate structure; and
WHEREAS, the Parking Consultant has submitted a report recommending
the increase in rates in certain on -street areas and in certain parking
facilities, to be effective January 1, 1981, in order to meet the debt service
requirement:
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. Section 35-91 entitled "On -street parking meters."
of the Code of the City of Miami, Florida (1980), as amended, is hereby

amended in the following particulars: —
"Sec. 35-91. On -street parking meters.
The rate of charge for parking in metered spaces in on -
street parking meter zones is as follows:
Central Business District, per hour $ 0730 A.40
(This is the area bordered on the East
by Biscayne Bay, on the West by Inter-
state Highway 95, on the South by the
Miami River, on on the North by North-
east and Northwest 5th Street.)

Section 4. The rates as provided in this Ordinance shall be
effective at 12:01 a.m. January 1, 1981.
- Section 5. All acts of the Off -Street Parking Board and its
Director as to rates heretofore charged are hereby ratified and confirmed.
Section 6. All Ordinances or parts thereof in conflict herewith
are repealed insofar as they are in conflict.
Section 7. The Director of Off -Street Parking shall cause
certified copies of this ordinance to be filed pursuant to Section 503 of
the Trust Indenture.
v Section 8. If any section, sentence, clause, phrase, or word
of this ordinance is for any reason held or declared to be unconstitutional,
inoperative or void, such holding or invalidity shall not affect the
remaining portions of this ordinance; and it shall be construed to have been
the intent of the Commission of the City of Miami to pass this ordinance
without such unconstitutional, invalid, or inoperative part therein; and

the remainder of this ordinance. after the exclusion of such
part or parts shall be deemed and held to be as valid as if
such parts had not been included therein.
Section 9. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace. health, safety and property of the City
of Miami, and upon the further ground of the necessity to make the
required and necessary payments to Department of Off -Street
Parking employees and officers, payment of its contracts, payment
of interest and principal on its debts, necessary and required
purchases of goods and supplies, and to generally carry on the
functions and duties of its municipal parking affairs.
Section 10. The requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of not
less than four -fifths of the members of the Commission.

Our Parking Consultant has reviewed the rates in our municioal
parking facilities and has recommended that they be revised in
order to meet our debt service coverage.
At the December 3rd meeting of the Off -Street Parking Board,
Resolution No. 80-637 was passed, accepting the report of our
Parking Consultant, recommending that the City Commission
authorize rate adjustments, to be effective January 1, 1981,
and instructing the Director to implement the new rate schedule
after the City Commission authorizes the changes.
Enclosed is our Resolution and a copy of the proposed City Com-
mission ordinance authorizing the rate adjustments. Will you
kindly place this item on your agenda for the December 17, 1980
City Commission meeting.
