City Ordinance Enforcement
Activity
This memorandum supplements my January 14, 1981 memorandum
to Commissioner Lacasa which has previously been distributed
to you.
In regard to this overall area of effective enforcement
activity, you should be aware that 12 chapters of the
City Code are being reviewed for the purpose of consolidat-
ing and compiling penal -type ordinances, in order to
establish a "Penal Code". Our present Code Chapter 37,
entitled "Offenses", will be the subject of major revision
and will form the nucleus of the "Penal Code". At the
present time, we are reviewing approximately 90 sections
of the Florida Statutes to consider the feasibilitv of
enacting those as ordinances and incorporating them into the
Penal Code.
On January 20, 1981, the County Commission passed an ordinance
which will allow the continued existence of our Code Enforce-
ment Board which was earlier established by your adoption of
Ordinance No. 9224 on December 17, 1981. We anticipate a -
much higher level of effective enforcement to result from the
operation of this Board with cases before it being presented
by our Office. At present, we have 16 pending cases in the
State courts involving adult entertainment establishments and
one case before the Federal District Court involving Federal
injunctive relief. These cases are being handled by our two
Special Municipal Prosecutors and are in addition to 9 pend-
ing Building and Zoning Code violation cases.
You will be kept informed of our progress in this area by
periodic reports.

Following my recent conference with you on this problem,
our staff addressed the area of possible increased anti -
crime activity. In our review of the subject with the
prospect of increasing the effectiveness of enforcement
activity, we have drafted the two attached ordinances for
your consideration at this time.
In addition, existing penal offenses are being reviewed
for compilation in a separate code chapter constituting
a "Penal Code".
We anticipate having a full report available in time for
the January 22nd Commission Meeting.
