All ORDINANCE AMENDING ORDINANCE NO. 6871. THE
COMPREHENSIVE ZONING ORDINANCE FOR T1:E CITY OF
MIAMI, BY CHANGING THE. 7.ONINC CLASSIFICATION OF
LOTS 11A AND 12A LESS THE PORTION TAKETI FROM
SR 836; BLOCK 1; LEJEUNE GARDEN ESTATES AMD (40-85),
BEING APPROXIMATELY 4245 N.W. 11TH STREET, FROM
R-3 (LOW DENSITY MULTIPLE) TO C-4 (GENERAL COMMERCIAL),
AND BY MAKING THE NECESSARY CHANGES IN THE 7ONING
DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871,
BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION
2 THEREOF; BY REPEALING ALL ORDINANCES. CODE SECTIONS
OR PARTS THEREOF IN CONFLICT AND CONTAINING A
SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board at its meeting of October
20, 1980, Item No. 7, following an advertised hearing, adopted
Resolution No. ZB 199-80 by a 6 to 0 vote (1 member absent)
RECOMMENDING a change of zoning classification, as hereinafter
set forth; and
WHEREAS, The City Commission after careful consideration
of this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAI14ED BY THE COWISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1, Ordinance 74o, 6371, The Comprehensive Zoning
Ordinance for the City of Miami, be and the same is hereby amended
by changing the zoning classification of Lets 11A and 12A less the
portion taken for SR 836; Block 1; LEJEUVE GARDEN ESTATES AT-M (40-85),
being approximately 4245 N. W. llth Street, from R.-3 (Low Density
Multiple) to C-4 (General Commercial) District, and by making the
necessary changes in the zoning district map made a part of said
Ordinance No. 6871, by reference and description in Article III,
Section 2, thereof.
Section 2. That all laws or parts of laws in conflict herewith
be and the same are hereby repealed insofar as they are in conflict.
Section 3. Should any part or provision of this Ordinance
be declared by a court of competent jurisdiction to he invalid,
the same shall not affect the validity of the Ordinance as a whole.

RECOMMENDATIONS
PLANNING DEPT. DENIAL. The proposed change of zoning does not conform
to the City's Comprehensive Neighborhood Plan which
specifies that this property be developed with moderate
density residential uses. Rezoning of this property to
General Commercial would have an adverse impact on the
surrounding neighborhood. It would allow uses such as
manufacturing and automobile repair which are not
compatable with the existing residential uses. Such a
rezoning would allow these commercial uses to use N.W.
llth and 12th Streets (two streets which are essentially
residential in character).
PUBLIC WORKS No dedication is requested.
D.O.T.T. D.O.T.T. has no objection to this proposal.
ZONING BOARD RECOMMENDED APPROVAL on October 20, 1980 by a
6-0 vote.
