ORDINANCE NO. 9237 A AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR. THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICATION OF W'LY 150' OF S1/2 OF N.E. 1/4 OF S.E. 1/4 OF S.W. 1/4 OF SECTION 32, TOWNSHIP 53S; RANGE 41r; UNPLATTED, BEING APPROXIMATELY 901 43RD AVENUE, FROM R-3 (LOW DENSITY MULTIPLE) TO C-2 (CORIUNITY COMMERCIAL) DISTRICT , AND BY MAKING THE NECESSARY CHANCES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871, BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF: BY REPEALING ALL ORDINATICES,COVE SECTIONS, OR PARTS TITEREOF IN CONFLICT AMD CONTAINING A SEVERABILITY CLAUSE. WHEREAS, the Miami Zoning Board at its meeting of October 20, 1980, Item No. 1, following an advertised hearing, adonted Resolution No. ZB 192-80 by a 6 to 0 vote (1 member absent) RECOMPT. ,,NDING a change of zoning; classification as hereinafter set forth; and WHEREAS, The City Commission after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; - 110W, THEREFORE , BE IT ORDAIIIED BY THE COMMISSION OF '►TIP CITY OF MIAMI, FLORIDA: Section 1. Ordinance T-1o. 6871, The Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification of W ly 150' of S1/2. of N.E. 1/4 of S.E. 1/4 of S.W. 1/4 of Section 32, Township 53S, Range 41F; UNPLATTED, being approximately 901 N. W. 43rd Avenue, from R-3 (Low Density Multiple) to C-2 (Community Commercial), and by making the necessary changes in the zoning district map made a part of said Ordinance 6871, by reference and description in Article III, Section 2, thereof. Section 2. That all laws or parts of laws in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Ir 9237 Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of t"le Ordinance as a whole. The proposed rezoning from residential (R-3) to commercial (C-2) zoning is not in accord with the City's Comprehensive Neighborhood Plan.
