PROPERTY ZONED R-5 (HIGH DENSITY MULTIPLE) DISTRICT. ,_ii to ,,ll yy �-�;uiiio�1'1T 11yULx ITEM No. WHEREAS. the City of Miami Zoning, Board, at its meeting; ' of December 15, 1980, Item No. 8, following, an advertised hearing., adopted Resolution No. ZB 235-80 by a 5 to 1 vote (1 member absent) recommending approval of a planned area develonment (PAD) as hereinafter set forth; and WHEREAS. the Citv Commission finds that the application meets all of the standards for PADS set forth in the Comprehensive Zoning; Ordinance. and WHEREAS, the City Commission finds that the applicant has followed all of the procedures and submitted all of the documents necessary in accordance with the Comprehensive Zoning Ordinance; and WHEREAS, the Citv Commission finds that the PAD meets all of the standards for a Conditional Use as outlined in ARTICLE XXI-1 of the City Comprehensive Zoning Ordinance, and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the Citv of Miami and its inhabitants to grant the petition for the application of a PAD; NOW, THERFFORE , BE IT RESOLVED BY TPT COPTISSIOPI OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION MEETING OF J A N 2 i,.;i1 81 L0 I Section 1. The Planned Area Development (PAD) on tract of land located between Northeast 34th and 35th Streets approximately theoretical Northeast 5th Avenue and Biscayne Bay, Tentative Plat No. 1099-A "BAY POINT PLACE", as per ARTICLE YYI-1 of Ordinance 6871 and plans on file, said Planned Area Development to consist of two hundred seventy three (273) apartment units in a proposed tower structure; subject to conditions recommended by the Urban Development Review Board: (1) A restudy and reconsideration of the tennis and racket ball courts area; (2) Providing of a landscaped public pedestrian easement adjacent to Biscayne Ray between 34th and 35th Streets; (3) Final landscape plan to be approved by the Urban Development Review Board including deck and pavement materials, Property zoned R-5 (High Densitv Multiple) District,is hereby granted. Section 2. The provisions of this Resolution shall become effective on March 15, 1981. PASSED AND ADOPTED this 22nd day of. January, 1981. ATTEST: RALPH G.
