WHEREAS, the South Florida Building Code is one of the
strongest building codes in the nation and addresses an
"urbanized" community's fire safety requirements; and
WHEREAS, there are efforts being made at the state
level to replace the South Florida Building Code with a
weaker and less stringent uniform building code; and
WHEREAS, the substitute code being considered has been
designated as the Standard Building Code or a modified version
thereof that would become the State :Maximum Building Code; and
WHEREIAS, the Standard Building Code or the State Maximum
Building Code is and would be primarily designed for rural
communities, in that it does not adequately address life safety
systems, nor does it provide that high-rise residential build-
ings be fully sprinklered, but permits other insufficient
alternatives; and
WHEREAS, the. Standard Building Code is also permis-
sive in its use of combustible building materials; and
WHEREAS, of the nearly one million building fires in
the United States in 1979, almost seven out of ten occurred
in residential occupancies, and annually fire claimed
1.2,000 lives; and
WHEREAS, the devastating and tragic "high rise"
f1GNt Grand Hotel fire, in which 84 lives were lost, re-
emphasizes the need for stringent fire safety regulations
in buildings through the application of building codes; and
WHEREAS, high-rise buildings are a special problem,
and from the standpoint of life safety, there is a need
for automatic fire estinguishing systems to provide quick "DOCUMENT
and effective response for fire extinguishment; and

WHEREAS, the Housing Goals Council and the State
Building Code and Standards Board are considering the
introduction of legislation that would require all Florida
counties to use a statewide maximum building code and
would deny Miamians and Dade Countians the protection
of the South Florida Building Code presently in force in
Dade County; and
WHEREAS, the South Florida Building Code is an appro-
priate and fitting building code to meet the distinctive
needs of most buildings which are being designed and built
in Miami and elsewhere in the Dade County urbanized
community;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MAIMI, FLORIDA:
Section 1. The Florida Legislature is strongly
urged to allow Dade County to maintain the South Florida
Building Code as the building code for Dade County.
Section ?. The City Cleric is hereby directed to
send a copy of the herein Resolution to those officials
listed in the attached schedule.

and adopted at its meeting held on January 22, 1981. It

Fire Protection Report
Following the devastating and tragic MGM Grand Hotel fire,
Vice -Mayor T. R. Gibson and Commissioner J. L. Plummer requested
information relative to the fire protection in structures within
the City of Miami,
The City of Miami Commission's request represents a unique oppor-
tunity to present a full and complete history of the City of Miami
Fire Department's progress and significant accomplishments regarding
fire protection within our community.
The attached report will be presented in the form of separate
papers which will address itself to the following vital areas
that deal with fire safety.
1. South Florida Building Code - New Construction

Indeed, it is my professional view that the Pliami Fire Department
is a leader both in the State of Florida and Nationally in terms
of our participation in the promulgation of provisions for sprinkler
protection for new construction in the South Florida Building Code
and the Fire Code amendments that were adopted by the City of Miami
Commission to our Fire Protection Chapter, that addressed itself to
increased life safety requirements, "retroactively", in existing
buildings.
I am very proud, indeed, to present this report to you and the
City of Miami Commission and I wish to state that we are currently
evaluating the effectiveness of the 1977 Code changes which have
been implemented and have been applied retroactively to existing
buildings; indeed, we are in the process'of studying our fire code
"Fire Protection Chapter" in terms of an annual review of its fire
and life safety provisions.

1. SOUTH FLORIDA BUILDING CODE - BUILDING CODE CITY OF MIA1I
Two City of Miami Fire Officials in 1972 played a significant role
in terms of the promulgation of a High Rise Sprinkler Ordinance in
the South Florida Building Code, and at their urging, the Board of
County Commissioners adopted Chapter 51 "Fire Suppression - Life
Safety System".
On July 14, 1973, the Building Code was amended to reflect that any
permits issued for new construction within the Dade County area would
have to comply with the following provisions, regardless of its occu-
pancy; i.e., hotels, condominiums, convention centers, City and County
buildings, hospitals, office buildings, institutions, etc.

2. FIRE CODE - FIRE PROTECTION CHAPTER - CITY OF MIAMI CODE
Chapter 17 - Fire Protection was created and passed on first reading -
March 28, 1966, by title only. On May 9, 1966, Ordinance 7431,
Chapter 17, was passed on second reading.
On July 25, 1966, Ordinance 7431, the Fire Protection Chapter, became
part of the Code of the City of Miami.
Fire Protection of the Code of the City of Miami was developed after
careful study, with the majority of its regulation referenced from
the National Board of Fire Underwriters "Model Fire Prevention Code",
now called the American Insurance Association's Model Fire Prevention
Code. This Code is still recognized nationally as a Model Code.
Our City's Fire Code also inculdes provisions that deal with our
local community; particularly Article II "Safety to Life Requirements
for Existing Buildings" with respect to interior finishes, heat pro-
ducing appliances, means of egress (exits), and protection of vertical
openings. The Fire Code is not a building code; it maintains those
features required by the Building Code. In very old buildings, that
at the time of construction were not required to have enclosed or
separated stairways, not required to have fire alarm systems, not
required to have two exits by the Building Code, the City of Miami
Commission amended the Fire Code, adopting provisions that permitted
retroactive enforcement of these life safety features to create a
reasonable degree of safety in older buildings.
The Chief Deputy State Fire Marshal, who formerly served on our
Department, assisted in the promulgation of our Code. It is his
current view that our Fire Code is the best in the State of Florida.
On passage of the Fire Code in 1966, with a small cadre of inspectors,
hundreds of portable unvented heaters were confiscated, exits were
installed for aduitional safety and protection of vertical openings
followed. The entire department participated in enforcing Ordinance
#7943 with respect to L. P. G. and natural aas installations.

3. MANUAL FIRE ALARAYSTEMS INSTALLED IN EXISAG BUILDINGS
The Fire Code was passed and adopted by the City of Miami Commission
on July 25, 1966. As stated previously, the Fire Code is not a
building code. Its purpose is to maintain those features that are
required by the Building Code. Within the City of Miami there are
rooming houses, boarding houses, apartment buildings, hotels, etc.,
that are 20, 30 and even 40 years old. These structures were not
required by the Building Code to have a manual fire alarm system
at the time of construction.
Under the provisions of the Fire Code, the Firefighting Division
and the Fire Prevention Bureau addressed itself to the installation
of fire alarm systems in Group fI occupancies, which are residential
buildings. The attached report, dated May 21, 1976, reflects the
completion of the application of manual fire alarm systems required
by the Fire Code in existing buildings.

4. AMENDMENT TO THE FIRE CODE ORDINANCE #8671, ADDITIONAL
RETROACTIVE FIRE SAFETY MEASURE TO EXISTING BUILDINGS - 1977
Following the tragic fire that occurred on April 3, 1976 at the
Avondale Hotel, in which ten lives were lost as a result of a
vicious act by arsonists, the Mayor and members of the City of
Miami Commission requested that the Fire Department conduct a
stud%, in terms of promulgating additional fire safety provisions
to existing older structures.
A code revision committee was created representing officials from
various fire services, citizen organizations, professional engineers
and architects and an Assistant City Attorney to develop regulations
that could be applied retroactively to buildings, and that would be
consistant ��rith the professional views of those who were knowledgeable
in the field of fire safety.
The attached Ordinance 78671, (Exhibit C) was passed and adopted by
the City of Miami Commission on July 14, 1977. The provisions of
this Ordinance deal with the inspections of fire alarm and fire
detection systems, the inclusion of office buildings required to
install manual fire alarm systems, one hour fire rated corridors,
self closers and positive latchinq devices on doors and offered an
alternative to buildings that were less than four stories in terms
of sinale station smoke detectors. The attached report, (Exhibit D),
dated January 8, 1979, is a final report wherein the enforcement of
the provisions of this Ordinance were applied to existing buildings
to provide additional fire safety protection to the tenants of these
older sturctures.

prohibited in partitions of corridors serving as'
exit access.
4. Doors to corridors from Group H occupancy shall be
self -closing with an approved spring loaded hinge
or closer and be,provided with positive latching
devices.

An alternate method of complying 'with Section 17-18 (b)

An approved series'of single station smoke detectors,
capable of sensing visible or invisible products of
combustion shall be installed in an approved manner.
The smoke detectors shall meet the requirements of
UL217, Standard for -single and multiple station smoke
detectors.
Smoke detectors may be powered by self -monitored
battery or directly connected (permanently wired) to
the electrical system of the building.
The application of smoke detectors to the building's
electrical system will require an electrical permit and
compL ce with the provisions of the National Electric.
Code NFFA No. 701975.
The detectors shall be installed in corridors, lobbies,
stair-»ays, storage and public areas and shall be.
approved by the Chief of the Fire•:revent:on Bureau
for the particular application, spacing and 'locations'.

Detectors shall be located on the ceiling not less tha,
six (6') inches from the side wall, or, if necessary,
on the side wall between six. (6'') inches to twelve (12'
inches from the deiling. Where unusual factors such
as corridor configuration, air movement, staggered
air pockets, etc. require consideration, the Chief of
the Fire Prevention Bureau shall approve the placement
of the detectors.
In corridors, detectors shall be installed a maximum
of 20 feet apart.
The smoke detectors shall be maintained in an operative
condition at all times as specified in Section 17-118
of this Chapter.
(c) Groups of occupancies defined:
Group A occupancy shall include assembly uses such as
theatres, auditoriums, motion picture houses, exhibition
halls, skating rinks, gyrnmnasiums, bowling alleys, pool
rooms, armories, restaurants, churches, dance halls,
club rooms, night clubs, meeting rooms, passenger rooms,
recreation piers, and similar uses having an occupant
content of one thousand or more persons.
Group B occupancy shall include assembly uses such as:
Division 1: Assembly uses set forth in Section 601
having an occupant content of three hundred to one taousa:
persons.
Division 2: Assembly uses as set forth in section
601 having an occupant content of less than three hundred
persons; except, that the occupancy of any room or space
for assembly purposes of less than one hundred persons in
a building or other occupancy and incidental to such othe:
occupancy shall be classed as part of the other occupancy
and subject to the provisions applicable thereto.
Group C occupancy shall include all schools having
classes more than four hours each week and providing
facilities for more than ten students or pre-school
children.
Accessory uses to schools not exceeding the following
maximums may conform to the requirements of this chapter:
Assembly halls 2100 square feet
Dining rooms 3000 square feet
Gymnasiums 3000 square feet
Shops having portable or fixed"power equipment or
tools not exceeding a combined total of twenty horsepower.
Such accessory uses exceeding the above -maximums
shall conform to the requirements of the occupancy group
which includes such use.

Group D occupancy shall include all institutional uses
as follows:
Division 1. Occupancy where *inmates' liberties a
restricted, such as jails, prisons, reformatories and
asylums.
Division 2. Occupancy where inmates are under
physical limitations, such as hosptials, sanitoriums,
hones for the aged and orphanages; and where accomoda-
tions are provided for more than six inmates,
Group E occupancy shall include such hazardous uses
as the storage and use of explosives, highly flamrable
liquids and highly 'combustible materials that are easily
i&nited and burn with extreme rapidity.
Division 1: Storage and handling of explosives ant
highly combustible materials such as, but not limited to.
Explosive manufacture, sales and storage; aluminum power
factories; cellulose -nitrate plastic factories; warehouse
and sales rooms; cereal twills; flour and feed mills;
grain elevators; mattress factories; rubber factories;
taste paper plans; and polyester storage and processing
plants.
Division 2: Storage and handling of Class I, II
and III fla=Able liquids, as set forth in section 4102
of the south Florida Building Code, and shall include
such uses as, but not limited to, distilleries, gasoline
bulk plants, lacquer factories, liquified petroleum gas
charg-ing or bulk storage plants, paint ,"I.an::factL'ring,
spray painting, storage and handling of paint thinners
and solvents and storage and handling of styrene corpournc
Group • F occupancy shall include storage .and industrial
uses as follows:
Division 1: Storage occupancy shall include ware-
houses, storage buildings, freight depots, public garage
of any size where repair wort; is done, parking garages
for more than four cars, gasoline service stations, air-
craft hangars or similar uses.
Division 2: Industrial occupancy shall include
factories, assen'oly and manufacturing plants, processing
mills, laboratories, loft buildings, creameries,. ratir.drie
ice plants, saw -ills, planing mills, box factories, wood-
working shops with fixed or portable power equipment or
tools exceeding a combined total of twenty horsepower and
other similar uses.
Group G occupancy shall include mercantile and business
uses as follows:
Division 1: Mercantile.occupancy shall include
retail stores, shops, sales rooms, markets and similar
uses. _
Division 2: Business occupancy shall include offic(
buildings, banks, civic -administration buildings, telephor
exchanges, museums, art galleries, libraries and similar
uses.
Group H'occupancy shall include =ultiple-residential
uses such as hotels, motels, apartment -hotels, apartment
houses, bungalow courts, rooming houses, do witories,
fraternity houses, monasteries, and similar uses which
provide accommodations for more than six persons.
Exception: a single-family residence containing no more
three bedrooms where no more than two persons per bed-
room shall be included in Group I occupancy.

Group I occupancy shall include: All single-family
uses and duplexes; dormitories, fraternity houses and
monastery uses when such buildings are used to domicile
no wore than six persons; buildings classified as Group
occupancy and Group D-2 occupancy when such buildings ar
used to house no more than six students or i,-,aces and
the appropriate supervisory personnel; and rooming house
when such rooming houses are operated in a single-family
residence ccntaining no more than three bedrooms, where
no more than two bedrooms are rented, such rooms being
used to house not more than two persons per bedroom.
(d) Types of construction defined:
Type 1. The 'structural frame of Tvpe I buildings or
structures shall be of steel or reinforced concrete; and
calls, permanent partitions, roofs and floors shall be
of inccmbustible fire -resistive construction, except as
otherwise set forth ehrein.
Type 11.
(1) The structural frame of Type II buildings or
structures shall be of steel or reiforced concrete; and
the exterior walls and interior bearing walls shall be
of incombustible fire -resistive construction; and except
in buildings of Group D occupancies, fire retardant
treated wood may be used for roof framing and, in buildir
not exceeding two stomas in height, •fire -retardant treats
wood .,,..ay be used for the interior structural framing -
elements. .

raterials as regulated herein.
Type
(1) (a) Type IIZ b,:ilcings or` structures shall have

(c) Partitions, floors and roof framing may

(2) (a) Type III (protected) buildings shall have
all interior bearing walls, partitions, ceilings and
floors of not less than one hour fire-resistant construc-
tion, except that the fire protection of floors may be
omitted 'as specified.
(b) Type III (unprotected) buildings may have
interior walls, ceilings and floors of unprotected steel
and wood or concrete. Interior bearing walls shall be
fire protected as specified. Floors shall.be fire pro-
tected as specified.
Type IV. All structural and other elements o: Type IV

COMBAT COMPANIES - FIRE CODE SAFETY PROGRAM

Fire Code Safety Program - When reviewing the overall mission of the
department as established under the Charter of the City of Miami and
Ordinance 47247, it is this department's belief that the prevention —
of fire is the single most important function in servicing this com-
munity. with that responsibility in mind, this department over the
past five years has focused its attention on Fire Prevention through
the deployment of 840. of its total personnel who are within the Fire-
fighting Division to the ambitious program of Public Education and
the prevention of fire through a Fire Safety Program. The program's
purpose is to inspect all residential and office buildings in the
City of Miami each year to secure compliance with the Fire Code and
instill public awareness through safety education in the more common
causes of fire and how to react in the event a fire should occur.
This program represented approximately 68,000 man hours in 1979.

Fire Prevention Bureau supervised 80 Fire Drills. Talks and lectures -
107 with a total audience of 12,118.
Forty-five Senior Citizen Surveyors hired in conjunction with "Senior
Aides, Dade County" and "Senior Community Service Employment Program"
under "Title V" of the Older American Act contacted 50,506 dwelling_
units, inspected 17,642 and found 10,043 hazardous conditions.
All Fire Inspectors in the Fire Prevention Bureau have been CERTIFIED
by Miami Dade Community College in conjunction with Dade County Ord n-
ance No. 78-30 and the Dade County Fire Safety and Appeals Board.
The certification examination material is from the South Florida
Building Code, the Life Safety Code and the City of Miami Fire Code.

6. SOUTH FLORIDA BU1.LjDING CODE - ATTEMPTS TO REPLACE THIS STRINGENT
CODE WITH A PERMISSIVE BUILDING CODE
The Dade County Fire Chief's Association, following the MGM Grand
Hotel fire, convened our Fire Prevention Committee, addressing it-
self to those aspects dealing with building codes and fire service
representation on the Board of Rules and Appeals. The State Housing
Goals Council has indicated to the State Building Code and Standards
Board the need for a "State wide maximum building code". The word
"maximum" means cannot be exceeded and, therefore, not beneficial in
terms of safety to citizens. The Building Code presently being con-
sidered for the entire State of Florida is the Standard Building Code
which does not adequately address high rises, fire protection features
and is very permissive in the use of combustible materials. The pre-
sent South Florida Building Code is one of the finest building codes
in the nation; it addresses itself to requirements for full sprinklered
buildings that exceed 50 feet and has full life safety provisions for
buildings exceeding 75 feet.
A proposed resolution will be presented to the City of Miami Commis-
sion, urging the Dade Deleaation, Governor Graham and the State Build-
ing Code and Standards Board that the City of Miami Commission and
Fire Service wish to maintain their South Florida Building Code that
provides stringent fire safety regulations in terms of high rise con-
struction, sprinklered buildings, smoke control, communication and
fire safety features.
On the State level, the "Housing Goals Council" and "State Building
Code and Standards Board" are beinq urged to adopt a "maximum" uniform
building code for the entire State of Florida.
The word "maximum" is deceiving, it leads one to believe it
is a strong code. In actuality, it means, "cannot be exceeded"
Statements are made that if South Florida can demonstrate the
need for more stringent requirements, they would be considered;
this would be a difficult process and unlikely to occur.
The building code that is proposed to replace the South Florida
Building Code is the "Standard Code". This code does not ade-
quately provide protection for high rise buildings, is very per-
missive in the use of combustible materials and is primarily
designed for rural communities.

South Florida Building Code
Resolution
As part of the Fire Protection Report that has been prepared for
the City of Miami Commission, a "paper" has been included regarding
efforts at the State level to replace the South Florida Building
Code with a Statewide maximum building code.
The Housing Goals Council and the State Building Code and Standards
Board are being urged to adopt a maximum uniform building code for
all Counties in the State of Florida.
1. The building code being considered is the Standard
Building Code. This coOn provides that in lieu of
high rises being fully sprinklered, such buildings
can be compartmentalized.
2. The Standard Code is primarily designed for rural
communities; it is permissive in the use of combus-
tible materials and does not addross "life safety
systems".
3. The word "maximum" is deceiving; it leads one to
believe it will be a strong code. Essentially,
"maximum" means the code provisions cannot be
exceeded unless there is a demonstrated need for
more stringent requirements. This would be a
difficult process and unlikely to occur.
4. The South Florida Building Code is one of the
strongest buildinc codes in the Nation and ad-
dresses an urbanized community's fire safety
requirements.

Building Code
A resolution is herein presented for the- City of Miami Commission's
consideration, relative to efforts being made at the State level to
replace our South Florida Building Code with a weaker and less strin-
gent uniform building code. The State Housing Goals Council has
indicated to the State Building Code and Standards Board the need
for a State maximum building code.
The following information is provided to the :Mayor and Commissioners
of the City of Miami regarding the impact that this would have upon
the City of Miami and Dade County.
1. The substitute code being considered is the Standard Building Code,
or a modified version called the State Maximum Building Code.
2. The word "maximum" means cannot be exceeded and, therefore, not
beneficial in terms of safety to citizens.
3. The new maximum code is, and would be, primarily designed for
rural communities.
4. The Standard Code does not adequately address life safety systems,
nor does it provide that high-rise residential buildings be -fully
sprinklered, but permits other insufficient alternatives.
5. The devastating and tragic high-rise MGM Grand Hotel fire, in
which 84 lives were lost, re-emphasises the need for stringent
fire safety regulations in buildings through the application of
building codes.
G. High-rise buildings are a special problem, and from the stand-
point of life safety, there is a need for automatic fire extin-
guishing systems to provide quick and effective response for
fire extinguishment.
7. The South Florida Building Code requires buildings exceeding 50
feet to be fully sprinklered and sets forth a full life safety
system for buildings exceeding 75 feet.
As Fire Chief for the City of t-iiami Fire Department, I urge that the
City of Miami Commission pass the attached resolution and advise those
officials listed in the attached schedule that the City of Miami wishes
to maintain the South Florida Building Code for our community.

Thank you for your letter of April 17 concerning the issue of a
statewide uniform building code for the State of Florida. Essentially,
four building codes are, and have been for many years, operative in Florida.
They are the South Florida Building Code, the Standard Building Code, the
Jacksonville Code and the EPCOT, (Walt Disney World), code. All are
considered to be excellent codes and are well suited to Florida's needs.
Fach, however, contains certain differences which preclude their being equal.
?'hese differences, coupled with local amendments to impose
additional and more stringent requirements, have created widespread diversity
in building construction requirements throughout the ,tate. This situation
has crated a widespread call for uniformity fran both code enforcement
officials and the construction industry. The lack of uniformity in codes has
been identified by virtually everyone who has studied the issue as contributing
unnecessarily to already high construction costs. Indeed, Metropolitan Dade
County has seen fit to ranedy this problem within its own jurisdiction by
requiring only the South Florida Building Code, (SFBC), for both the county
and its municipalities. Broward County requires the SFBC county wide also,
yet it uses its own, (and different), edition of the same code.

A RESOLUTION STRONGLY URGING THE FLORIDA
LEGISLATURE TO ALLOW DADE COUNTY TO MAINTAIN
THE SOUTH FLORIDA BUILDING CODE AS THE BUILD-
ING CODE FOR DADE COUNTY, AND DIRECTING THE
CITY CLERK TO FORWARD COPIES OF THE HEREIN
RESOLUTION TO CERTAIN DESIGNATED PUBLIC
OFFICIALS.
WHEREAS, the South Florida Building Code is one of the
strongest building codes in the nation and addresses an
"urbanized" community's fire safety requirements; and
WHEREAS, there are efforts being made at the state
level to replace the South Florida Building Code with a
weaker and less stringent uniform building code; and
WHEREAS, the substitute code being considered has been
designated as the Standard Building Code or a modified version
thereof that would become the State Maximum Building Code; and
WHEREAS, the Standard Building Code or the State Maximum
Building Code is and would be primarily designed for rural
communities, in that it does not adequately address life safety
systems, nor does it provide that high-rise residential build-
ings be fully sprinklered, but permits other insufficient
alternatives; and
WHEREAS, the Standard Building Code is also permis-
sive in its use of combustible building materials; and
WHEREAS, of the nearly one million building fires in
the United States in 1979, almost seven out of ten occurred
in residential occupancies, and annually fire claimed
12,000 lives; and
WHEREAS, the devastating and tragic "high rise"
MGM Grand Hotel fits, in which 84 lives were lost, re-
emphasizes the need for stringent fire safety regulations
in buildings through the application of building codes; and
WHEREAS, high-rise buildings'are a special problem,
and from the standpoint of life safety, there is a need
for automatic fire estinguishing systems to provide quick
and effective response for fire extinguishment; and
WHEREAS, the South Florida Building Code requires
buildings exceeding 50 feet to be fully sprinklered and
sets forth a full life safety system for buildings e�oiAhUS$IN I

WHEREAS, the Housing Goals Council and the State
Building Code and Standards Board are considering the
introduction of legislation that would require all Florida
counties to use a statewide maximum building code and
would deny Miamians and Dade Countians the protection
of the South Florida Building Code presently in force in
Dade County; and
WHEREAS, the South Florida Building Code is an appro-
priate and fitting building code to meet the distinctive
needs of most buildings which are being designed and built
in Miami and elsewhere in the Dade County urbanized
community;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MAIMI, FLORIDA:
Section 1. The Florida Legislature is strongly
urged to allow Dade County to maintain the South Florida
Building Code as the building code for Dade County.
Section 2. The City Clerk is hereby directed to
send a copy of the herein Resolution to those officials
listed in the attached schedule.
