RELEASING THE CITY OF MIAMI FROM ALL
CLAIMS AND DEMANDS.
WHEREAS, SUSAN NEVINS, through her attorney, John G.
Shiley, filed a claim against the CITY OF MIAMI and alleged
bodily injury, personal injury protection liens, and Work-
mens Compensation liens, resulting from an accident that
occurred on April 18, 1977, at or near Southwest 23rd Avenue
and 2nd Street, in the City of Miami, Florida; and
WHEREAS, the above claim has been investigated by the
Torts Division of the City Attorney's Office in accordance
with Ordinance No. 8417 which creates the City of Miami's
Self -Insurance Program, and said Office recommends that
this claim be settled for the sum of Ten Thousand One Hun-
dred and Thirty Two Dollars and 80/100 ($10,132.80);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
authorized to pay to SUSAN NEVINS, without the admission of
liability, the sum of Ten Thousand One Hundred and Thirty
Two Dollars and 80/100 ($10,132.80) in full and complete
settlement of all bodily injury, personal injury protection
liens, Workmens Compensation liens, all claims and demands
against the CITY OF MIAMI, by any parties, upon the execution
of a Release, releasing the CITY OF MIAMI from all bodily injury,
personal injury protection liens, Workmens Compensation liens,

This claim arose from an accident wherein Susan Nevins
tripped and fell on a raised sidewalk flag at Southwest
23rd Avenue and 2nd Street, Miami, Florida. The owner-
ship and condition of the sidewalk had been verified
and the responsibility rests with the City of Miami. The
defect has been corrected by the Public Works Department.
As a result of the accident, the Plaintiff, Susan Nevins,
suffered a displaced fracture to her right patella with
offset. She was initially treated at the Emergency Room at
the Coral Gables Hospital. An operation of open reduction
and internal fixation was performed on 4/26/77 by Dr. Robert
L. Tindall at Doctor's hospital. She incurred medical
expenses in the amount of $3,518.45.
Medical expenses and other items of damage have been veri-
fied. After extensive settlement discussions and nego-
tiations, it has been determined that the matter can be
settled for $10,001.00, plus $131.80 in court cost.
The above claim has been investigated by the City of ,Miami
Attorney's Office and in accordance with Ordinance No. 8417,
which creates the City of Miami's Self -Insurance Proaram,
said office recommends that the City of Miami pay $16,132.80
to Susan Nevins.
