HomeMy WebLinkAboutR-81-0078r7 i RESOLUTION NO. 81 " "7 8 A RESOLUTION EXPRESSING AN INTENT ON THE PART OF THE CITY OF MIAMI TO SHARE UP TO FIFTY PER CENT (50%) OF THE COST OF RECRE- ATIONAL DEVELOPMENT AND BULKHEAD REPAIR AT BAYFRONT PARK AND CERTAIN IMPROVEMENTS THEREON, WITH THE UNITED STATES ARMY CORPS OF ENGINEERS; FURTHER INTENDING TO CONVEY A STRIP OF BAYFRONT PARK TO THE UNITED STATES ARMY CORPS OF ENGINEERS FOR THE CONSTRUCTION OF A BAYWALK, WITH SAME BEING LEASED BACK TO THE CITY OF MIAMI AT NO COST, UPON COMPLETION OF THE PROJECT. WHEREAS, the City of Miami is interested in upgrading and enhancing its Bayfront Parks; and WILREAS, the United States Army Corps of Engineers, under its Code No. 710 Recreational Facilities Program, has proposed to build a baywalk in the Park and install "rip rap"; and WHEREAS, the cost of the project will be shared 50/50 .)etween the United States Army Corps of Engineers and the City of Miami; and WHEREAS, the City of Miami's match could be through the value of the land donated for this public project; and WHEREAS, the land would be leased back to the City of Miami at no cost for continued public benefit and use; and WHEREAS, the City Manager recommends; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. It is the intent of the City of Miami Commission to share up to fifty per cent (50%) of the cost of recreational development and bulkhead repair, including a baywalk in Bayfront Park, with the United States Army Corps of Engineers. Section 2. I would like to take this opportunity to encourage your support for this technical matter which would enable the Corps of Engineers to proceed with the construction of the bulkhead and baywalk portions of the Park project. As you know, I have continued to devote my efforts to seeing that the local commitment to the redevelopment of the Bayfront Park is matched by Federal funding assistance. I am pleased to note that this interest has been rewarded as indicated by the appropriation of funds for work to be carried out by the Department of the Army. Of course, there is still much to be done, but I am confident that, with your good help, we can look forward to future funding guarantees leading to completion of the Noguchi design concept. Your favorable consideration of this matter before the Commission and continued support are certainly in the public interest. Fosmoen February 4, 1981 - City Manager ' Bayfront Park Bulkhead and Baywalk Carl Kern, D'rector Dep ent of Parks - y-f-- T It is recommended that the City express its intent to cost share with the Corps of Engineers in the development of the Bayfront Park Bulkhead and Baywalk. This is the initial phase of the-- Bayfront Improvement Project approved by the Commission on October 30, 1980. Following the initiative of Congressman Claude Pepper and the Downtown Development Authority, the U. S. Corps of Engineers has indicated its desire to cost share with the City of Miami in the development of the Bayfront Park Bulkhead and recreational Baywalk. This project, estimated at $1.5 to $2 million is to be funded by the Corps' Code 710 recreational development program. This is a 50/50 matching basis program which would require the Citv to contribute half of the project cost or approximately $750,000-$1,000,000. The Corps has indicated,,however, that it would accept, as the City's share, the value of the land on which the project is to be developed. This would require the City to deed, in fee simple, the (approx. 150 ft. wide - see diagram) strip to the Corps. The Corps would then develop the bulkhead and baywalk and lease it back to the City at no cost on a 25 year renewable lease. The Corps is ready to proceed and will provide the estimating, design, construction, and supervision services. Before starting, however, they need a statement of intent by the City to cost share on this project (see attached letter). Subsequent real estate agreement (including fair market appraisal) and contract to proceed would then be forthcoming from the Corps in tdarch for full Commission review and approval. The project, a baywalk on the waterfront perimeter, has been determined to be eligible under our 50/50 cost sharing Code 710 program provided certain conditions are met. These conditions are: a. The land involved in the development of the linear park along the bayfront must be deeded to the Federal Government in fee title. ' b. When the project is completed, land and facilities will be leased back with a renewable 25 year lease at no cost to the City. Under the above mentioned conditions the City of Miami will be given credit for the value of the land towards its fifty percent share of the total develop- ment costs. Total development cost includes Engineering and Design, (E&D), construction cost and Supervision and Administration (S&A) during the construction period. Assuming the above conditions are acceptable we will need a letter from the City of Miami stating their intent to cost share on this project and agreement to deed the portion of land involved in this development to the Federal Government. A draft recreation contract and lease between the City and the Government will be prepared at a later date and the draft will be submitted for your review and approval.
