HomeMy WebLinkAboutO-09241FRH/wpc/o 1/8/81 ORDINANCE NO. 99,41 1 AN ORDINANCE PROHIBITING THE OBSTRUCTION OF FREE PASSAGE OVER, ON, OR ALONG STREETS OR SIDEWALKS AFTER REQUEST BY A LAW ENFORCEMENT OFFICER TO CEASE SUCH OBSTRUCTING; FURTHER, _ PROVIDING FOR PENALTIES; CONTAINING A REPEAL- ER PROVISION AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. It is the intent of this ordinance to eliminate the obstruction of free passage over, on, or along a street or sidewalk which obstruction results from the manner in which a person or number of persons shall stand, loiter or walk on said street or sidewalk. Section 2. (A) It is unlawful for any person or any number of persons to so stand, loiter or walk upon any street or sidewalk in the City of Miami so as to obstruct free passage over, on or along said street or sidewalk after a request by a law enforcement officer to move on so as to cease blocking or obstructing free passage thereon. (B) The provisions of Section 2(A) hereof apply only when a person or number of persons shall stand, loiter, or walk on a street or sidewalk so as to obstruct free pass- age and shall refuse to obey a request by an officer to move on; mere refusal to move on after a law enforcement officer's request to move on is not enough to support the offense. There must be an actual blocking of free passage over, on, or along said street or sidewalk. (C) A violation of the provisions of Section 2(A) hereof shall be punishable by not more than sixty (60) days imprisonment or by a fine of not more than Five Hundred Dollars ($500.00) or both. 0=" Section 3. It is the intention of the City Commission that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami, Florida, and the sec- tions of this ordinance may be renumbered or relettered to accomplish such intention; and that the word "ordinance" may be changed to "section", "article", or other appropriate word. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent with or in conflict with the pro- visions of this ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this ordinance shall be held to be unconstitutional or invalid, the remaining provisions of this ordinance shall not be affected.
