WHEREAS,
the City has proposed construction of Phase I of Jose Marti
Riverfront Park houridecl by SW 2nd Street on the north, SW Gth Street on the
south, SP: 4th Avenue on the west and by SW 3rd Avenue and the Dliami River
on the east; and
WHEP.IAS, the CITY had previously identified approximately $1,585,852 to
finance the professional fees, the construction, and the other project expenses
for Phase I of t?le Park's Development; and
VIIII'MAS, the li ami. City Coruni ssi.on by Resolution No. 79-576, adopted
September 1.3, 1979, authorized the City :tanager to conduct a design competition
and to al-I,oint an impartial. Jury for the selection of the competition winners,
and also authorized tile: City manacier to negotiate a professional services
agreement: with the competition winners: P:allacc, Roberts and Todd, Architects,
in compliance with Ordinance No. 1905 adopted July .12, 1979; and
1•:1I)."REAS, the !-liami City Corunission adopted Resolution No. 80-472
authorizi.nu the enviagenvont of th" con:.;ultant architectural firm of Wallace,
Roberts and Todd to provide professional services, for the design and construction
consultation of Phase I of the T'ar.k, using previously allocated Fourth Year,
Community Development: funds in the amount of $92,000; and

and approved.
Section 2. They City Mlanayer is hereby authori ed to execute the attached
Supplemental Aclreement No. 1 to the original agreement, elated July 16, 1980,
with I-I'allace, Roberts and Todd, to provide professional services for the
desi(in and construction consultation of Phase I of Jose Marti Riverfront Park,
using previously allocated Fourth Year Community Development funds for said
agreement.

of Revised Phase I Program, Approval
of Master Plan and Report, Authori-
zation to Execute Amendment to
Consultant's Contract.
"It is recommended that the Revised Phase I Development
Program and the Master Plan and Report for Jose Marti
Riverfront Park prepared by the Architectural Consult-
ant firm of Wallace, Roberts and Todd be approved; and
authorization be given the City Manager to execute the
attached amendment to the Consultant's contract dated
July 16, 1930, with said firm which allows for the
increased Scope of the Phase I Project."
on November 6, 1980, the City Commission adopted Motion 80-812 preliminarily
approving the Master Plan and Report for Jose Marti Riverfront Park, with
request that a list of modifications to Phase I development, as discussed
by the City Commission that date, be furnished the City Commission before
final action of accenting the Master Plan. Subsequent to this action, the
U. S. Department of Interior, Heritage Conservation and Recreation Service,
awarded the City a Development Grant of $719,730 through the Urban Parks
and Recreation Recovery Program increasing the identified funding for Phase I
Development from $1,585,852 to $2,305,582.
Based upon the Commission's modifications and taking into account the increased
funding to be available for Phase I
development, the following

With reference to the siting of the Cafe within 50' of the waterfront, the
50' Setback Charter Amendment states that "these requirements shall not
apply ....to public and private facilities on City -owned properties." It
also states that modifications to the setback requirements can be made if
such modifications "provide public benefit such as direct public access,
public walkways, plaza dedications .... or comparable benefits which promote
a better urban environment and public advantages of...." The consultants
and the Department feel that the cafe greatly enhances and facilitates
public enjoyment of the river and fully meets the criteria established
by the Amanrlrnonf-
Identified funding for Phase I Development now totals $2,305,582 and includes
provision for the following:

Based upon approval of the actions being, requested of the Commission on February 26th,
we estimate completion of design and construction documents the latter part of

tHtS SUPP UMENTAL AGREEMENT NO. 1, made and entered into this
day of 19A1, by and between the CITY OF MIAMI,
a municipal corporation of the State of Florida (hereinafter referred
to as the "CITY") , and V,'AI,LACE, ROBEPTS AND TODD, Architects '(hereinafter
referred to as "PRINCIPAL").
WIT:IEUSETH
WHEREAS, on July 16, 1980, the CITY entered into agreement with
the PRINCIPAL to provide professional services for the design and con-
struction consultation of Phase I of Jose Marti Riverfront Park, then
known as Latin Riverfront Park; and - —_
WHEREAS, said agreement held I)rovision for the CITY requesting an
increase in the scope of the Phase I Project by the PRINCIPAL should
additional fundino become available; and
WHEREAS, the U. S. Department of the Interior on January 9, 1981,
awarded the CITY a development grant in the amount of $719,730, increasing
the identified funding for Phase I Development from $1,585,852 to $2,305,582;
and
WHEREAS, this additional funding for Phase I development makes it
possible to increase the scope of recreational elements to be included
in Phase I, namely a swimming pool complex; and
WHEREAS, increasing the Scope of the Project will necessitate an amend-
ment to the professional services agreement with the PRINCIPAL, including
increase in the consultant's fee to $133,718, based upon terms of the
existinq contract dated July 16, 1.980; and
WHEREAS, the conceptual Master. Plan and Report were reviewed on
November 6, 1980, and preliminarily approved by the Miami City Commission
by Motion No. 80-812 , subject to modifications; and
WHEREAS, the conceptual Master Plan and Report have been revised to
include said modifications also tal:in(:; into account the increase in the
Scope of the Phase I Project hecause of additional funding; and
