WHEREAS, Southeast Banking Corporation and Gerald D.
Hines Interests have submitted a complete Application for
Development Approval for Southeast Bank Financial Center,
a Development of Regional Impact, to the South Florida
Regional Planning Council pursuant to Section 380.06,
Florida Statutes, and did receive a favorable recommendation
from the Council on December 15, 1980; and
tIHEREAS, the City Commission by Resolution No. 81-36,
January 15, 1981, issued a Development Order approving with
modifications the Southeast Bank Financial Center; and
IniEREAS, the staff of the South Florida Regional Planning
Council met with a City representative on February 16, 1981
to express certain concerns; and
14HEREAS, it is the desire of. the City Commission to cooperate
with the Regional Planning Council by offering certain assurances
to allay the concerns of the Council staff;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF KAMI, FLORIDA:

Section Is The Administration is authorized to prepare
plans, specifications and estimates for the design and
engineering of all surface street improvements in DuPont
Plaza by September, 1982, and the manager is directed to
proceed on September 11, 1981, if on that date the Florida
Department of Transportation does not have a consultant under
contract committed to completing construction documents
12 months thereafter.
Section 2. The Administration is directed to .refer any
Second Level Pedestrian Circulation Plan for DuPont Plaza to
the South Florida Regional Planning Council for review and -
comment.

Section 3. It is the intention of the Commission to con-
dition variances and conditional uses pertaining to the parking
garage in DuPont Plaza, being requested by Southeast Banking
Corporation by requiring that the applicant either complete
the construction of the pedestrian overpass above Southeast
Second Street or post- a performance bond, enforceable by

the City, for 150% of the estimated cost of the overpass,
120
days prior to a request for a Certificate of occupancy for
the parking garage.

Section 4. The City Clerk is directed to immediately
transmit this Resolution to Mr. Barry Peterson, Executive
Director, South Florida regional Planning Council, 1515 N.W.
167th Street, Suite 429, t;iami, Florida.

The attached Resolution clarifies the intent
of the City regarding certain concerns raised
by the South Florida Regional Planning Council
staff on the City Commission approved Southeast
Bank Development Order. (Resolution Sl-36:
January 15 , 1981. )
BACKGROnND :
On Tuesda%, February 16th, City staff met with the staff of the
South Florida Regional Planning Council and discussed three con-
cerns related to the City approved Development Order on Southeast
Bank which could lead to an appeal recommendation by the Council
staff. These concern~ folio«•:
1. Clarification of the intent of the City to complete
the desi,n of the surface streets by September of
1982.
2. Clarification of the intent of the City to insure
_ mpletion of tile SE co2nd Street pedestrian cross l-Mr

RECOMMENDATION:
The City Commission should enact the Resolution (attached)
which deals with the above mentioned points which indicates:
1) that the City agrees to complete design of the surface
streets by September of 1982 if the State cannot complete
the design by that time: 2) that the City will require as a
condition for granting Conditional Use approval of the
Southeast Rank Garnoe , that the Rank will be required to
either complete construction of the pedestrian overpass above
SE 2nd Street before the issuance of a Certificate of Occupancy,
or comply by the presentation of a performance bond for 150
of the estimated cost of the pedestrian bridge 120 days prior
to the request for a Certificate of Occupancy: and 3) that the
City Commission will direct its pedestrian promenade consultant
to review the plan with the South Florida Regional Planning
Council (assuming concurrent review by the City -appointed Rlue
Ribbon C"mmi t tee) prior to approval of the plan by the City
Commission.
It is recommended that the attached Resolution be enacted to
clarify the City's intent and to preclude a possible appeal of
the Southeast: Development Order. It is further requested that
this item be brought un on the daytime agenda of February 26, 1981.
