AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 9199,
THE CITY'S CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE
FOR FISCAL YEAR 1980-81, AS AMENDED; BY INCREASING THE
APPROPRIATION FOR SUBSECTION XV, PARKING CAPITAL PROJECTS
FUND, (ITEM 8.1.) IN THE AMOUNT OF $110,000 FROM A LOAN
FROM THE CAPITAL IMPROVEMENT FUND, PROCEEDS OF THE INTERAMA
LAND SALE, FOR THE DOWNTOWN GOVERNMENT CENTER PARKING
GARAGE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY
CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME
ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS
OF THE MEMBERS OF THE COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9199 on
November 6, 1980, establishing resources and appropriations for
the implementation of capital improvements in the City of Miami,
Florida, for the Fiscal Year ending September 30, 1981; and
WHEREAS, the City Commission desires to finance by revenue
bonds, construct, and operate a parking structure in the Downtown
Government Center; and
WHEREAS, the cost of design and related services contracts
through the Bidding Phase will be $110,000; and
WHEREAS, $110,000 is available for the aforementioned purpose
as a loan from proceeds of the Interama land sale; and
WHEREAS, funds in the amount of $110,000 will be available
from the anticipated Downtown Government Center revenue bonds upon
sale of said bonds for the repayment of funds to the proceeds of
the Interama Land Sale Fund;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:*
Section 1. Section 1 of Ordinance No. 9199, adopted
November 6, 1980, the City's Capital Improvement Appropriations
Ordinance for Fiscal Year 1980-81, as amended, is hereby further
amended in the following particulars: x/
"Section 1. The following appropriations hereby made by
fund and project title include previously authorized
projects and fund appropriations for implementation of
all municipal capital improvements of the City of Miami,
Florida. The sources of revenue to support the herein
appropriations are hereby identified by fund and project:
1/ Words and/or figures stricken through shall be deleted. Underscored
words and/or figures constitute the amendment proposed. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material. All figures are
rounded to the next hundred dollars.
*Said ordinance to become effective only upon receipt of a favorable written opinion
from the City Attorney as to the use of the proceeds from the Interama land sale.

Section 2. Repayment of the above -mentioned loan, including
interest computed at the average prevailing rate for the loan period,
will be made to the proceeds of the Interama Land Sale in the Capital
Improvement Fund upon the sale of the Downtown Government Center
revenue bonds.
Section 3. All ordinances or parts of ordinances insofar as
they are inconsistent'or in conflict with the provisions of this
ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 5. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than
four -fifths of the members of the Commission.

You should be advised that the passage of Ordinance #9247� -
an appropriations ordinance amending the current Capital Improve-
- mer.ts Ordinance (#9199) by way of a loan to Capital Improvements
Funds was directly conditioned upon receipt of a legal opinion
by this office that the use of the proceeds of the Interama
land sale as such source of funding was legal and proper.
Further, the passage of Resolution #81-114 authorizing the use
- of the appropriated Capital Improvements Funds for a parking -
study for the Downtown Government Center would also be in- -
directly conditioned upon receipt of such ruling from this -_
office.
The sale proceeds of 8 million dollars arose from the March 13,
1980, Agreement between the City and the Board of Trustees of
the State of Florida with the City agreeing to use the $8,000,000
for purposes as defined in Section 125.0104(5)(A) of the Florida
Statutes.
Since the amount needed for the Ordinance appropriation was

It is recommended that $110,000 be appropriated
from the Interama proceeds in the Capital Improvement
Fund to the Parking Capital Projects Fund to cover
the cost of continuing the design through the Bidding
Phase of the Downtown Government Center Parking project.
Upon the sale of revenue bonds to finance the remainder
of the design and construction of the project, the
monies loaned to the Capital Projects Fund will be
rayed to the Capital Improvement Fund.
On November 26, 1980, by Ordinance No. 9191, the City Commission
appropriated $115,000 from the Capital Improvement Fund on a loan
basis into the Parking Capital Projects Fund, for a .total amount
of $175,000 as of that date in order to cover the costs of design
services through the Design Development Phase, financing services
and related services for the Downtown Government Center Parking project.
Since then, the architectural,/engineering firm of Wilbur Smith and
Associates, Inc., have proceeded to the Design Concept Phase and
the James J. Lowrey Company, Inc. has developed a financial plan to
market revenue bonds. It is in the best interests of the City to
continue with the design through the Bidding Phase and to prepare
the way for selling the revenue bonds. Then, when the market
stabilizes, the City will be in a most favorable position to complete
the development of the project.
It is recommended that the City Commission appropriate $110,000
to be used for the continuation of the design portion of the work;
these monies to be appropriated into the Parking Capital Projects
Fund on a loan basis from the Interama proceeds in the Capital
Improvement Fund.
