ORDINANCE NO. ,92 46
AN ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND
ENTITLED: "RESCUE SERVICES" PROVIDING FOR REVE-
NUES THEREIN TO BE RECEIVED FROM THE SOUTHERN BELL
TELEPHONE AND TELEGRAPH COMPANY ADDITIONAL ONE
PERCENT FRANCHISE FEE TO PROVIDE FOR THE FUNDING
OF SALARIES AND RELATED OPERATING COSTS AND EQUIP-
MENT FOR THE FIRE DEPARTMENT'S EMERGENCY MEDICAL
RESCUE SERVICES FOR FY 1981; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND DIS-
PENSING WITH THE REQUIREMENT OF READING SAME ON
TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -
FIFTHS OF THE MEMBERS OF THE COMMISSION.
WHEREAS, Ordinance No. 9064, adopted January 24, 1980, granted the
Southern Bell Telephone and Telegraph Company, its successors and assigns, a
franchise granting the right to the use of public right-of-way to install
necessary telephone equipment; and
WHEREAS, said ordinance provides for a one percent franchise fee, to
be augmented by one percent on January 1, 1981, and again on January 1, 1982;
and
WHEREAS, said
ordinance provides for
all
payments
in excess of one
percent to be deposited
in a special account to
be
used for
funding emergency
medical rescue services and equipment; and
WHEREAS, an amount of $512,325 in anticipated Southern Bell addi-
tional one percent franchise fees, as specified above, can be appropriated
into a Special Revenue Fund entitled: "Rescue Services" to provide for the
funding of salaries and related operating costs and equipment for the Fire
Department's Emergency Medical Rescue Services;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The following Special Revenue Fund is hereby estab-
lished and resources are hereby appropriated as described herein:
FUND TITLE: Rescue Services
RESOURCES: Southern Bell Telephone and Telegraph
Company Additional One Percent Franchise Fee $512,325
APPROPRIATION: Rescue Services $512,325"

Section 2. The herein appropriation of $5120325 into a Special -
Revenue Fund entitled: "Rescue Services" is for the purpose of providing for
salaries and related operating costs and equipment for the Fire Department's
Emergency Medical Rescue Services in FY 1981.
Section 3. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining pro-
visions of this ordinance shall not be affected.
Section 5. The requirement of reading this ordinance on two sepa-
rate days is hereby dispensed with by a vote of not less than four -fifths of
the members of the Commission.

It is recommended that $512,325 in Southern Bell
Telephone and Telegraph Company additional one
percent (1%) franchise fees be appropriated into
a Special Revenue Fund entitled: "Rescue Services"
to provide for the funding of salaries and re-
lated operating costs and equipment for the Fire
Department's Emergency Medical Rescue Services in
Fiscal Year 1981.
Ordinance No. 9064, adopted January 24, 1980, grants the Southern Bell
Telephone and Telegraph Company, its successors and assigns, a fran-
chise granting the right to the use of public right-of-way to install
necessary telephone equipment.
Additionally, the ordinance provides for a one percent (1%) franchise
fee to be utilized for funding emergency medical rescue services and
equipment January 1, 1981 through December 31, 1981, and for two
percent (2%) beginning January 1, 1982 through August 11, 2006.
It is anticipated that the first payment of Southern Bell Telephone
and Telegraph fees will be received on February 25, 1981. The esti-
m ated revenue from January 1 through September 31, 1981 will be
$512,325.
The attached proposed ordinance provides for $512,325 in Southern Bell
Telephone and Telegraph Company additonal one percent (1%) franchise
fees to be appropriated into a Special Revenue Fund, entitled: "Rescue
Services." An additional rescue unit was placed in service on March 23,
1980 and has been operating out of Fire Station No. 10, 4101 N. W.
7th Street.
This proposed ordinance has been prepared for the February 26, 1981
City Commission meeting. -
