WHEREAS, the Miami Zoning Board,, at its meeting of January 19, 1981, Item #7, foll,owing an advertised hearing, adopted Resolution No. ZB 14-81 by a 4 to-1 vote (2 members absent) RECOMMENDING DENIAL for �a change,'of zoning classification, as hereinafter set forth; and r WHEREAS, the City CommisAon, notwithstanding the denial by the Zoning Board finds '�h*t the use will not be detrimental or injurious to the character of the development of the immediate neighborhood; a NOW, THEREFORE, BE IT ORD INED BY THE COMMISSION OF THE t CITY OF MIAMI, FLORIDA:` Section 1. The D.O.T.T. has no objection to this proposal. DENIAL. The proposed change of zoning would not PLANNING conform to the City`s Comprehensive Neighborhood Plan which designates this area as remaining DEPARTMENT': under moderate density residential use. The pre- dominate land use of the area is single and two-family residential, with liberal commercial development'being located only with frontage along North Miami Avenue and N.E. 36th Street. "SUPPORTIVE DOCUMENTS FOLLOW Reasonable development opportunities exist for the site under the existing zoning. The site can either be developed with an apartment, office, hotel or bank building. With Conditional Use approval, an open parking lot could be constructed. Rezoning of the property to C-5 would have an adverse impact on the neighborhood. There would be no way to restrict commercial traffic from the residential neighborhood. The Liberal Commercial Zone would permit uses which are not compatible with residential development. Such a rezoning would only continue to encourage similar encroachments into the residential neighborhood.
