Background On several occasions t1ayor Ferre has indicated to the Downtown Miami Business Association and the Downtown Development Authority that the City may be able to make Watson Island available to downtown interests for a temporary parkinq lot to alleviate the severe parking shortage downtown brought about by recent growth in CBD employment and the elimination of thousands of parking spaces due to construction of major new developments. The DDA requested an opinion of the City Attorney regarding any legal impediments to using Watson Island for parkins. The opinion is attached. The deed conveying to the City contains a restriction limiting the island's use to a "public purpose." As per the City Attorney opinion, parking in and of itself is not a public purpose. However, parkinq created as a result of a City declared emergency would be a public purpose. Hence the enclosed Resolution has been submitted for City Commission consideration. As we informed you, the deed restrictions from the State of Florida to the City of Miami concerning Watson Island restricts the use of that parcel of land to those projects that are deemed to be municipal and public purposes. While a parking facility is per se not deemed to -be a public purpose, it is our recommendation that the City Commission make a finding of a public and municipal purpose. Specifi- cally, it is suggested that the City Commission make the determination that an acute parking problem exists in the downtown area and that a public purpose would be served by using the Watson island location as a temporary parking facility.
