OF A CONDITIONAL USE. AS LISTED INI ORDINANCE

TO PERMIT A DRIVE-IN TELLER FACILITY III
CONJUNCTION WITI1 BANK ON LOTS 1,2,3,4
AND 5; BLOCK 621-1; MIAMI (B-41) BEING
APPROXIMATELY 550 NORTHEAST SFCOND AVENUE
AS PER SITE. PLANTS ON FILE. WITH THE
VOLUNTARY DEDICATION OF THE SOUTH 10 FEET
OF LOT 17 ; ZONED C-3 (CENTRAL COrMWIRCIAL) .
WHEREAS, Article XXXII, of the Comprehensive Zoning Ordinance
No. 6871 ermits an extension of a conditional use by the City
Manager with approval of the City Commission, for a one year period;
and
WHEREAS, the City Manager recommends the extension of the
conditional use �-ranted by Zoning, Board Resolution No. 136-80;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIA1,11 , FLORIDA:
Section 1. The request for a one year extension of the
conditional use granted from Ordinance No. 6871, Article XII,
Section 1(33) (f), to permit a drive-in teller facility in con-
junction with bank on lots 1,2,3,4 and 5; Block 62N; MIAMI (B-41)
being approximately 550 Northeast Second Avenue as Per site Plans on
file with the voluntary dedication of the south 10 feet of Lot 17;
zoned C-3 (Central Commercial) be and the same is herebv granted.

PLANNING DEPT. APPROVAL IN ACCORD WITH THE PLANS ON FILE.
The proposed accessory parking facility is not
in conflict with current downtown parking
efforts and is needed for support of the
motel activites. The drive-in tellers provide
for sufficient automobile stacking but they are
not as convenient to the public as they should
be.

requested.

ARTICLE XXXII of the Comprehensive Zoning Ordinance No. 6871 provides
that any Conditional Use shall expire six months after the effective
date of the Conditional Use unless a Building Permit or a Certificate
of Use has been issued based upon the Conditional Use. The Ordinance
further provides that the City Manager may, after review and deter-
mination that substantial progress has been achieved by the applicant
in terms of project planning, extend the expiration date of the Condi-
tional Use for an additional period of time not to exceed one year,
subject to approval of the City Commission.
Planning Dept. finds no objection to the granting of the extension
of time for these Conditional Uses.
We are requesting the City Attcrney's office, by copy of this memo, to
prepare the proper Resolutions for these extensions.

I represent Errol Eisinger and 17.orr„an M. Nierenberg, Trustees,
the owners of the above -captioned property, who received
approval of two conditional uses, Zoning Board Resolution
Numbers 135-80 and 136-80 for a 550-car parking, garage and
drive-in teller facility, respectively.
My clients have achieved substantial progress in project planning
including continuing with working drawings and presentations to
prospective lessees and financial institutions; however, they
will not be in a position to draw the building permit until some -
tire after January 7, 1981. Therefore, I am requesting your
approval of a one --year extension of the conditional uses and that
the same be timely placed on a City Commission agenda pursuant
to the provisions of Article XXXII, Section 3 (2) of the City of
Miami Comprehensive Zoning Ordinance.
