WHEREAS, the Miami Zoning Board at its meeting of
December 1, 1981, Item No. 9, folloz.,ing and advertised hearing,
adopted Resolution ',lo. 7R 228-80 by a 4 to 3 vote f,rantingwith
the voluntary dedication of n15' of Lot 8, the variance from
Ordinance 6371, Article X, Sections 3(2) (d) and 6, as hereinafter
set forth; and
I%TPEREAS, the annlicant has taken an anneal from the
denial of the variance to the Cite Commission; and
tTHERI:AS, the City Commission after careful consideration
of this matter finds that due to peculiar circumstances affecting
this parcel. of land. practical. difficulties and unnecessar-
hardships could impair the owner's right to the reasonable use of
the property without the variance granted as hereinafter set
forth.
'NOW, THEREFORE, BE IT RESOLVED BY TIDE COMIISSIO'7 OF THE
CITY OF MIAMI, FLORIDA;
Section 1. The Zoning. Board's granting of a variance
as per Ordinance No. 6871, Article X, Sections 3(2) (d) and 6,
to nermit construction of a 10-unit apartment building* on Lot 8
less 1'15' ; E GEtVATER TERRACE (9-57) , being arnroximately 700
Northeast 22nd Terrace, as per plans on file, with 16' side street
yard (20' required), 21' side vard (28.75' required), and 27.7*! lot
coverage (23%, allowed) ; zoned R-5 (High Density r"ultinle Ioelling)

REQUEST Variance to permit construction of a 10-unit apartment
building on above site, as per plans on file, with 16'
side.1treet yard (20' required), 21' side hard (28.75'
required), and 27.71 lot coverage (23%' allowed).
RECOMMENDATIONS
PLANNING DEPT. DENIAL. There is no hardship which justifies granting
the requested variances. Adequate space is available
on site to allow for reasonable development. This
building could be redesinged in several ways to comply
with zoning regulations. Unit sizes or the space used
for enclosed common areas could be reduced to bring
down the lot coverage and to meet the setback require-
ments. Another alternative would be to reduce the
the building height by 2 stories to toal 4-stories
(40'),and thereby bring the lot coverage into comformity.
Unless the building is modified to comply with all
zoning regulations, the site (which is only the size
of two single-family lots) will be overdeveloped and
development will infringe on the rights of other property
owners in the area and it will create an undesirable
situation.

A RESOLUTION to provide for this Variance has been prepared by the City
