WHEREAS, the City of Miami, by Resolution 80-563, adopted
a Citizen Participation Plan on July 24. 1980, in order to
provide procedures for citizens to participate in the Community
Development Block Grant Program; and
WHEREAS, Section B. Part III, of said Plan sets forth
rules governing conflict of interest and nepotism for Forum and
Advisory Board Meetings; and
WHEREAS, based on issues raised by the community, it is
recommended that Section B, Part III. be amended to be applicable
to all individuals participating in the neighborhood advisory
process; and
WHEREAS, Section B, Part XIV, of the Citizen Participation
Plan authorizes the City Commission to amend any part of said Plan;
NOW, THEREFORE. BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section B, Part III, of the City of Miami
Citizen Participation Plan adopted on July 24, 1980, by Resolution
80-563, is hereby amended to read as follows:
Rules Governing Conflict of Interest and Nepotism
for Individuals Participating in the Neighborhood Advisor
Process.
Conflict of Interest
Any Community Development Advisory Board member.
Forum officer, Community Developement subcommittee
member, Community Development voter or an employee

of any organization that will benefit financially
either directly or indirectly_ from any action
by the neighborhood advisory process waith respect
to Community Development or other Community Develop-
ment related activities shall make that interest
known and shall refrain from voting upon or otherwise
participate in such action. This shall include par-
ticipation on any neighborhood subcommittees whose
recommendations could influence the establishment of
a plan which may financially benefit directly or
indirectly that individual(s).
Nepotism
Any Board member, Forum officer, subcommittee member
or Community Development voter, who has a member of
his/her immediate family who will benefit financially
either directly or indirectly as a result of action
before the Board, Forum or neighborhood advisory
committee will make known that relationship and will
refrain from voting or otherwise participating in
such action. For the purpose of this section, a
member of an immediate family will include any of the
following:
Wife, Husband,
Father. Father-in-law,
Mother, Mother-in-law,
Brother, Brother-in-law.
Sister, Siter.-in-law,
Son, Son-in-law,
Daughter, Daughter-in-law,
Stepson, Stepdaughter.
Violation of these g�-,idelines will be grounds for
removal of a Chairperson/Vice-Chairperson, Board
member, or committee member.

Amendment to Section B, Part III
of the City of Miami Citizen Partici-
pation Regarding Interest & Nepotism

It is recommended that the City Commission amend Section B,
Part III of the Citizen Participation Plan, Rules Governing
Conflict of Interest and Nepotism for Forum and Board meetings.
This amendment would expand applicability of conflict of
interest and nepotism to all persons participating in the neigh-
borhood advisory process, per the attached resolution.
At the Community Development public hearing of January 22, 1981 a concern was
expressed regarding individuals participating in a neighborhood advisory process
and possibly using the information obtained to serve self interests.
In response to this concern, we have reviewed our citizen participation plan
with respect to conflict of interest and nepotism. As written in the plan, it
is not explicit that the rules governing conflict of interest and nepotism are
applicable to all individuals participating in the neighborhood advisory process.
It is, therefore, recommended that in order to minimize the possibility of an
individual participating in the neighborhood advisory process and influencing a
plan that could potentially serve that individual's interest, that the citizen
participation be amended to address conflict of interest and nepotism for all per-
sons participating on a neighborhood advisory committee.
According to Section B, Part XIV of the Citizen Participation Plan, the City Com-
mission is authorized to amend any part of the plan.
Commission approval of the attached resolution is recommended.
