HomeMy WebLinkAboutO-09251AY`. r its ORDINANCE NO. . � 1 1 ' 10� AN ORDINANCE AMENDING SECTIONS 53-869 53-87, 53-88, 53-899, 53-90, 53-93 and 53-94 OF THE CODE OF THE CITY OF MIAMI, FLORIDA (1980)9 AS AMENDED, WHICH ESTABLISHED DOCKAGE RATES AT DINNER KEY MARINA AND ANNEX, MIAMARINA, AND THE WATSON ISLAND MARINA, BY REPEALING SAID SECTIONS IN THEIR ENTIRETY AND SUBSTI- TUTING THEREFOR A NEW SECTION AUTHORIZING THE CITY MANAGER TO ANNUALLY ESTABLISH AND ASSESS NEW DOCKAGE RATES UPON CONSIDERATION OF DESIG- NATED CRITERIA; ESTABLISHING AND ASSESSING, NEW DOCKAGE RATES PURSUANT TO EXHIBIT A ATTACHED HERETO; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 53-86, 53-87, 53-88, 53-89, 53-901 53-93 and 53-94 of the Code of the City of Miami, Florida (1980), as amended are hereby further amended by repealing the said sections in their entirety and substituting; therefor the following: "Sec. 53-86. Dockage rates. The dockage rates at all city marinas shall be established annually by the city manager prior to the first day of September and assessed effective the first day of October upon consideration of the following criteria: (a) Bond debt service requirements of no less than one hundred and fifty percent (150%) coverage. (b) Return on proposed or previously completed, nonbonded, capital improvements, as approved by the city commission. (c) Operating expenses, as approved by the city commission. (d) Management fees of any private management firm engaged in providing management services to the marinas. X or, (e) Reserve for improvements and major mainten- ance, as established by the city commission. (f) Other city financiLl needs, as may be determined by the city commission. The dockage rates shall not exceed those charged by privately operated South Florida marinas of comparable quality and offering like services, and shall be no less than other marinas, unless otherwise authorized by the city commission." Section 2. Commencing effective April 1, 1981, the dockage rates at all city marinas shall be established as set forth in EXHIBIT A, attached hereto and, by reference, made a part4tereof. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. ® Section 4. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Paragraph 6 of Exhibit A to the enclosed ordinance was not a part of those changes directed by the City Commission but was added by this department for con- sideration by the City Commission as a part of the Second Reading procedures relative to final passage of the ordinance. This department recommends passage of the enclosed ordinance on Second Reading with the inclusion of paragraph 6 to Exhibit A thereto. " 4251 EXFIBIT A DOCKAGE RATE SCHEDULE The rates charged at City Marinas shall be as follows: 1. From April 1, 1981 until September 30, 1981, 16& per foot per day, based on slip length with no charge for electrical hookup. The rate charged for transient vessels shall be 30& per foot per day based on the size of boat. 2. Commencing; effective October 1, 1981, 21� per foot per day, based on slip length, with a surcharge for liveaboards of 6t per foot per day based on slip length in addition to the aforesaid 21�. The rate for transient vessels shall be 36� per foot per day based on size of boat. ?. Commercial vessels shall receive a forty percent (4050) discount on the above rates. 4. Persons presenting to the Dockmaster a validated Homestead Exemption Certificate in their names on residences located within the City of Miami shall receive a twenty per cent (20%) discount on the above rates. 5. Users of the Dinner Key Marina Annex and tlatson Island Marina shall receive a thirty percent (305) discount on the above rates until such time as these marinas are renovated. ^- 6. Users of City marinas who are entitled to more than one of the above discounts may select the most favorable discount, but may not receive more than one discount at any Given time. 7. On and after October 1, 1982, rates charged at City marinas shall be adjusted annually* on the basis of the Federal -Consumer Price Index for the previous twelve (12) month period. 9Zr)1 4
