HomeMy WebLinkAboutO-09254ORDINANCE NO. ) 4 AN ORDINANCE AMENDING SECTION 8 OF ORDINANCE NO. 9243, ADOPTED FEBRUARY 26, 1981 WHICH AMENDED CODE SECTION 2-233 OF THE CODE OF THE CITY OF MIAMI, FLORIDA (1980), AS AMENDED, BUT INCORRECTLY LISTED IN THE AFORESAID CODE SECTION AS "2-333" BY CORRECTING THE SCRIVENER'S ERROR IN SAID SECTION 8 OF ORDINANCE NO. 9243 TO ACCURATELY READ 'SECTION 2-233"; CONTAIN- ING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. Section 8 of Ordinance No. 9243, adopted February 26, 1981 is hereby amended in the following particu- 1/ lars: "Section 8. Section 2-333 2-233 of the Code of the City of Miami, Florida (1980), as amendedL is hereby amended by repealing said section in its entirety and substituting the following in its place and stead: 'Sec. 2-333 2-233. Internal Audit Function. The management, supervision and control of the internal audit functions to be performed on behalf of the City shall be the responsi- bility of the Office of Internal Audits'." Section 2. The above amendment is made expressly for the purpose of correcting a scrivener's error which incorrectly recited the Code Section being amended in the earlier Ordi- nance (No. 9243) as "2-333" instead of "2-233". Section 3. All ordinances or parts of ordinances inso- far as they are inconsistent or in conflict with the provi- sions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affec- ted. ------------------------------------------------------------- l/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures constitute the amend- ment proposed. The remaining provisions are now in effect and remain unchanged. M 401 Section 5. Knox, Jr. Cit Attorney � March 25, 1981 Ordinance Amending Ordi- nance #9243 Due To Scrivener's Error Attached hereto is a proposed ordinance amending a numbered reference to a Section of the City Code which was being amended by Ordinance No. 9243, adopted February 26, 1981. The original Ordinance (No. 9243) in describing the Code Section incorrectly listed the same as Code Section "2-333" inEtead of Code Section "2-233". The subject matter of the original ordinance dealt with the transfer of the management, supervision and control of the City's internal audit functions to a separate Office of Internal Audits. The original Ordinance (No. 9243) remains the same except for the herein proposed change in the Code Section designation which is necessary to correct the "scrivener's" error.
