INSURANCE
The Club shall obtain a'policy of general liability insurance
in the amounts of not less than $300,000 per.occurrence for
bodily injury, and $50,000. per occurrence for property damage,
for the use, benefit and protection of the City and/or its
officers, agents and employees. The insurance policy and the
company.shall be'approved 'by the City, and a copy of each policy of

insurance to be filed with the City. The City; shall be named in
each such policy of insurance as an additional or secondary
insured,

the Club G6Venants and agrees that the protion of the Concrete -
dOck,`on Club property shall be used by the City pursuant to the Decomber D, 19C01-
agreement provided that the northeasterly side of said thttbachment shall
be utilised by the Club for the purpose of docking boats, said use being incidental
to Club operations, and further provided that no commercial use shall be ailowed,
The City agrees to provide the right of ingress and egress to Club
members and their guests for the purposes incidental thereto,
USING THE_ PItLMtSES
Said premises and'the improvements theron are to be used for docking
purposes by Club, its members and their guests only, on a non profit basis, with
the limitation of seventy -two (72) consecutive hours use by any such guest of
any member. clothing herein contained shall be construed to prevent necessary
temporary docking for unrestricted number of hours by any vessel or other
craft in distress, or for the preservation of either life or property.
XII, NON DISCRIVINIATION
The Club agrees that there will be .no discrimination against any

person on account of race, color, sex, religious creed, ancestry or national
origin, in the use of the demised premises and the improvements thereon.
It is expressly understood that upon proof of discrimination the City shall
have the right to terminate this contract,
XIII. SIGNS
The Club shall not permit any signs -other than those incidental to
the operation of the docks and safety., orother advertising to be used or

displayed on the demised premises or on the improvements located thereon,

The Club covenants and agreesto indemnity and hold harmless the City`,
its officers, agents and employees, from and ast any and all claims,' s
suits, actions, damages or causes of action arising durihl the term', of this
a0ecement, for any personal injury, loss of life, or damage to'property
sustained in or about the demised premises, by reason of, as a result of, or
arising out of the Club's occupancy thereof, and from and against any orders,
judgiments, -r decrees which` may be entered thereon, and against all costs,
attorney s lees, :expenses and liabilities incurred in and about the defense of
any such claim and the investigation thereof,, provided, however, that before the
Club shall become liable for any -such cost, the Club shall be given
notice in writing that the same are about to be or may be incurred, and the
Club shall have the option itself to make the necessary investigation and
employ counsel of the Club's own selection, for the necessary defense of
any. claims. The City; at its option, 'shall retain its own counsel at its
sole cost and expense (in addition to'the provisions` as h`ereinabove'>set "
forth) ,
XVII. UTILITIES,
The Club shall be solely responsible to pay for all utilities used
in the demised premises, and in the concrete dock described herein,'
XVIII» EXAMINATIO„ OF THE pREi1ISES BY THE CITY
The Club aarees to permit tile City, by its designated hersonnel,,to.
enter upon the premises at any time for any reasonable purpose.
