In conformance with Sections 18=6 through 18-10 of the City of Miami Code, ,the Arts in Public Places Committee followed procedures leading to a reportrecommending that the firm of J, Fuhrman, Bernard"Srenneri- Sculpture Associates be engaged as the Artist to ''create an original sculpture for the new Solid Waste Department Administration Building. See attached memorandum from Brenda Williamson to the City Manager, dated February 27, 1981. This item was placed on the March 17 agenda and was deferred by - City Commission with the request that all art work for this project be approved at one time. It is however recommended that.the City Commission take action on this item because further delays in contracting for the construction of the proposed sculpture that is made of high grade expensive steel ('corten) may result in additional costs to the City. The proposed resolution,provides for the following City Commission actions; 1) approves.the recommendation.of'the City Manager to engage the firm of J. Fuhrman, Bernard Brenner, Sculpture Associates as the Artist to create an original sculpture for the new Solid Waste Department Administration Building; 2) authorizes the City —; Manager to execute an agreement (attached hereto):with the Artist' for an amount of $9,900 for all artistic' services; and 3) authorizes the City Manager to expend that amount from the Pollution Control and Incinerator= Bond Fund for the artistic services. Prepare models, drawings, Cartoons, mock` -ups or other displays for 'preliminary "presentation 'to the CITY,- 3, Fabricate and e.cecute the WORK into "its `final form after approval by the CITY of the preliminary presentation. 4 Supervise and be responsible for the shipment of the WORK. 5.' Supervise and be responsible for the installation of the WORT: at the Solid Waste 'Office Building. 6. Provide and pay for all material, labor and related services in connection With this Agreement,,. C. Preliminary Presentation After ,execution of this Agreement and after receivi-ng a'Notice to Proceed from the CITY _MANAGER, make'a Preliminary Presentation of his design concept to the CITY MANAGER or his designee, and the Art -in -Public Places Committee. The ARTIST may use such displays,` as models, drawings, mock-ups or other items,' as hedeemsnecess'ary,;to illustrate to the CITY MANAGER his, design concept and its setting', its size, materials ,and other relevant characteristics. The Preliminary Presentation shall be considered complete by the CITY when the CITY MANAGER approves the ARTIST'S concept, P. mobilization upon approval of the Preliminary Presentation, prepare his studio for the undertaking of the WORK under this Agreement, The ARTIST shall arrange for the purchase'of materials and for all '5orvivea rpcpired to fabriQAte and complete the Ws?RX 1.n a manner' ' that Will mept tha time uqu emunts of this Agreement. When the work is approximately seVenty-five percent (7�) complete, the ARTIST shall present photographs of"the WORK to the CITY MANAGER or his designee and the Art -in -Public Places Comm'ittee. for their review. If convenient, the CITY MANAGER, or his deskgnee> and the Art -in -Public Places Committee will examine the WORK at the . ARTIST'S studio'. The CITY MANAGER will approve the WORK if it is found satisfactory and will authorize its completion.' Fabrication shall be considered complete by the CITY when the ARTIST notifies the COORDINATOR that the WORK is ready for Shipment to the site. F. Installation Install the WORK at the site "of the Solid Waste Office Building. The ARTIST shall be responsible for'all crating, uncrating, transportation, installation and related activities that [nay be required to transport the WORK from the ARTIST'S studio or place of fabrication and to install it at the site of -the Solid Waste Office Building, The installation shall be considered complete by the CITY when the CITY aceepts the WORK in place and after the ARTIST has returned 411 documents loaned to him.
