HomeMy WebLinkAboutM-81-0435ORDINANCE N0. ;r AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMP HENSIVE ZONING ORDINANCE FOR THE CITY 0 MIAMI, BY CHANGING THE ZONING CLASSIFICATION 6F N.W.1/4 OF THE S.E.1/4 OF SECTION 35, TOWN-,' SHIP 53 SOUTH, RANGE 41 EAST; APPROXIMATELY BOUNDED BY: VIAMI DADE WATER AND SEWER DEPARTMENT PROPERTY ON THE EAST, N.W. 11TH STREET ON THE SOUTH, N.W. 12TH AVENUE ON THE JEST AND EAST - WEST EXPRESSWAY (SR-836) ON THE NORTH (MI",1ICIPAL JUSTICE TRACT); BEING APPROXIMATELY 941-1199 N.W. 11TIl STREET, FROM R-C (RESIDENTIAL OFFICE) TO GU (GOVERNMENTAL USE DISTRICT), AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE 6871 BY REFERENCE AND DESCRIPTION I14 ARTICLE III, SECTION 2, THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVER - ABILITY CLAUSE. '- I " WHEREAS, the Miami Planning Advisory Board, at its meeting of Ntay 6, 1981, Item 12, following an advertised hearing„ adopted Resolution No. PAB 21-81 by a vote of 6 to 0 (2 members absent) RECOMMENDING DENIAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, notwithstanding the recommended denial of the Planning Advisory Board, finds that the use will not be detrinental or injurious to the character of the development of the immediate neighborhood; NOW, THEREFORE, BE IT ORDA114ED BY THE C%11ISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance of the City of Miami, be and the same is hereby amended by changing the zoning classification of 1N.W.1/4 of the S.E.1/4 of Section 35, Township 53 South, Range 41 East; approximately bounded by: Miami Dade Water and Sewer Department property on the east, N.W. llth Street on the south, N.W. 12th Avenue on the west and East-West Expressway (SR-836) on the north (Municipal Justice Tract); being approximately 941-1199 N.W. llth Street, from R-C (Residential Office) to G11 (Governmental Use District), and by making the necessary changes in Zoning District Map made a part of said Ordinance No. 6871 by reference and description in Article III, Section 2, thereof. Section 2. That all laws or parts of laws in conflict herewith he and the same are hereby repeal(_d insofar as they are in conflict. 4 Should any dart or provision of this Ordittabte be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. .t� PREPARED AND APPROVED BY: TERRY V. LOTH AVENUE AND EXTENDING 1014.26 + EASTERLY MORE PRECISELY DESCRIBED IN DEED DATED DECEMBER 12, 1980 FROM SEABOARD COAST LINE RAILROAD COMPANY TO THE CITY OF MIAMI RECORDED ON THE OFFICIAL RECORDS OF DADE COUNTY BOOK 10979 PAGE 101, BOHEMIA PARK AMD (6-171), and UNPLATTED - PART OF N1/4 OF NE1/4 SE1/4 OF SE1/4 OF SECTION 26, TOWNSHIP 53 SOUTH, RANGE 41 EAST LESS E182' AND LESS S35' FOR STREET; E182' OF N1/4 OF NE1/4 OF SE1/4 OF SE/4 OF SECTION 26, TOWNSHIP 53 SOUTH, RANGE 41 EAST, LESS NW 7TH AVENUE AND LESS S3.5' TO SAL RY; FROM C-5 (LIBERAL COMMERCIAL) AND I-1 (LIGHT INDUSTRIAL) TO GU (GOVERNMENTAL USE DISTRICT); AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFLICT AND CONTAINING A SEVERABILITY CLAUSE.
