Santana, Agenda Coordinator CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on Thursday, July 13, 2023, at 9:00 A.M. at City Hall, located at 3500 Pan American Drive, Miami, Florida, 33133 for the purpose of granting the following: A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION AND ACCESS EASEMENT AGREEMENT ("EASEMENT"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO 191 SW 12 OWNER LLC, A DELAWARE LIMITED LIABILITY COMPANY ("DEVELOPER"), FOR A NON- EXCLUSIVE EASEMENT ON CITY OF MIAMI ("CITY") OWNED PROPERTY LOCATED AT 140 AND 142 SOUTHWEST 11 STREET (FOLIO NOS. 01-0208-050-1010 AND 01-4138- 051-0380) AND 1105, 1115, 1131, 1133 SOUTHWEST 2 AVENUE (FOLIO NOS. 01-4138- 051-0400, 01-4138-051-0410, 01-4138-051-0390 AND 01-4138-051-0420), MIAMI, FLORIDA ("CITY PROPERTY") FOR THE PURPOSES OF PROVIDING ACCESS AND INGRESS THERETO AND EGRESS THEREFROM, OVER, UPON, THROUGH AND ACROSS THE CITY PROPERTY, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE EASEMENT AND CONSISTENT WITH THE "PUBLIC BENEFIT AGREEMENT REGARDING CONSTRUCTION OF THE NEW FIRE STATION NO. 4" RECORDED ON APRIL 13, 2020 IN OFFICIAL RECORDS BOOK 31909, AT PAGE 847 OF THE PUBLIC RECORDS OF MIAMI- DADE COUNTY, FLORIDA (AS AMENDED, RESTATED, SUPPLEMENTED AND REPLACED FROM TIME TO TIME, (THE "PBA"); FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY TO EFFECTUATE SAID EASEMENT The Miami City Commission requests all interested parties be present or represented at the meeting and may be heard with respect to any proposition before the City Commission in which the City Commission may take action. Should any person desire to appeal any decision of the City Commission with respect to any matter to be considered at this meeting, that person shall ensure that a verbatim record of the proceedings is made including all testimony and evidence upon which any appeal may be based (F.S. 286.0105). Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City Commission meeting is cancelled or is not held due to a lack of a quorum or other emergency, a special City Commission meeting will be automatically scheduled for the Tuesday immediately following the cancelled meeting. In the event of one of the aforementioned circumstances, the special meeting would be held on July 18, 2023, at 9:00 a.m. in the City Commission chambers located at Miami City Hall, 3500 Pan American Drive, Miami, FL 33133. All of the scheduled agenda items from that cancelled meeting shall automatically be scheduled as an agenda item at the special City Commission meeting. The City Clerk shall notify the public of the special meeting that is to take place by placing a notice of the special City Commission meeting at the entrance of City Hall and the City's main administrative building, placing a notice on the City's website, and, if feasible, placing an ad in a newspaper of general circulation before the special meeting on the immediately following Tuesday. There shall be no additional notice by publication required for any such scheduled agenda item that is moved to the special City Commission meeting. In accordance with the Americans with Disabilities Act of 1990, persons needing special accommodations to participate in this proceeding may contact the Office of the City Clerk at (305) 250-5361 (Voice) no later than five (5) business days prior to the proceeding.
