The lease betweentheCity and Belafonte Tacolcy Center, Inc. has expired. An opinion has been given by the Law Department that, because of the -non-profit public service purpose of the Center, a new lease can be entered into without the necessity for competitive biddinz-. This proposed lease provides for a five year term with a five year renewal option upon the request of the Center. The annual rent of,"i+�64,416.00 is to be retained by the -Center as a City contribution to the programs and projects provided to the community by t*,:e Center. The City will provide maintenance and utilities (excluding - telephone) and the Center will provide custodial services for the buildings and grounds. I The Belafonte Tacolcy Center, Inc. has provided a variety of public service and community oriented pro?rams'while occupying this City facility and wishes to continue doing so. The Lease Manager is in the process of renegotiating a lease agreement between the City and Belafonte Tacolcy, Inc. Based upon ihstructions; Mr. Harrison has suggested to Mr, Otis Pitts; Director of the Belafonte Tacolcy Center,it the existing building and its now additions totaling 6052 square feet be .eased for the s=e'terrs as in the expired lease. This would mean no charge for rent,utilities or maintenance and a five year term with a five year option to renew. With the fair market value of this space being approximately,$7.00 per square foot, this would be, the equivalent of a donation by the City of approximately $42,364.00 peryear. This in -kind contribution by the City can assist the Center in obtaining grants and other federal assistance. The new building now under construction, comprising 3150 square feet, would be leased at $4.50 per square foot. This rate would include all utilities and maintenance to be paid by the City, and a five year term and a five year option to renew. This would cone to $1li,175.00 per annur., or-$1,181.25 monthly. The $4.50 per square foot rate is comparable to rentals being charged social service programs at the Little Habana Community Center. There will be no additional charge for the sports and recreation area now being constructed at the Center: The fi•✓e year term with a five year renewal is identical to the ter:.1 in the expired contract. This allows the City to re6ain control if subsequent management of the facility does not meet' City, standards. It is the opinion of the Lease '.ana�;er that the public interest would not be served b;; ;deeding; thin land and its impro•✓events to a private agency. Tile land and improvements were purchased throu4h public funds and the City is acting as trustee for this public land.
