AN ORDINANCE AMENDING SUBSECTION (B) OF SEC -PION 53-146 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA (1980) AS AMENDED
WHICH CHANGES THE CITY OF MIAMI TAX ON ADMISSIONS 'TO THE
MIAMI BASEBALL STADIUt-i FOR THE USE OF THE ENTIRE STADIUM
AND FIELD (FOR FESTIVAL SEATING) FROM 10% Of TIME GROSS AD-
MISSION PRICE TO 12% OF THE GROSS ADMISSION PRICE; FURTHER
DEFINING EVENT COSTS COVERED BY THE CITY TAX ON ADMISSIONS;
CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE;
AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO
SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR-I,IrTHS OF
THE MEMBERS OF THE COMMMISSION.
WHEREAS, there is at present in the City Code, established rates for
admissions to be charged for specific events to be held at the Miami Baseball
Stadium; and
WHEREAS, the City has established a Citv Tax on each admission to said
Stadium for the use of the entire Stadium and Field (for festival seating)
of logo of the gross price of each admission sold, less any Federal, State,
or locally imposed tax payable from such admission price; and
WHEREAS, it is found that in order to be competitive with other stadium
facilities located in the State of Florida, the City Tax on this category of
event should be increased from 10% of gross price of each admission sold to
12% of the gross price of each admission sold, less any Federal,
State, or locally imposed tax payable from such admission price and that
the event services rendered under this City Tax be increased to include
Police Department Personnel required for traffic control and crowd control
outside of the Stadium;
NOW, THEREFORE, BE IT ORDAINED SY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Paragraph (c) of Subsection (B) of Section 53-146 of the Code
of the City of ?Miami, Florida (1980), as amended, is hereby further amended
in the following particulars

(c) For use of the entire stadium and the field (for festival
seating) for nonathletic events only, there shall be assessed
a fee which shall be the greater of two thousand five hundred
d o l la r s ($2, 500.00) per day or a city tax on each
admission to the stadium of ten-419} twelve (12) percent
of the gross price, as established by the user, on each
admission ticket sold by the user for the event to be held
in the stadium, less any federal, state, or locally imposed
tax payable upon such admission price. The two thousand five
hundred dollars ($2,500.00) per day or teas-f19} twelve (12)
percent of the gross admission price, whichever is greater,
shall include electricity and Police Department Personnel
required for traffic control and crowd control outside the
stadium, but the user shall. pay all other event costs,
including, but not limited to, inner security, inner crowd
control, electricians, custodial personnel, office attendants,
elevator operators, cleanup and other like expenses.

Section 2. All ordinances, or parts of ordinances, insofar as they are
inconsistent or in conflict with the provisions of this ordinance, are hereby
repealed.
Section 3. If any section, part of section, paragraph, clause, phrase
or word of this ordinance is declared invalid, the remaining provisions of
this ordinance shall not be affected.
Section 4. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Commission.

Change in Rental Rate for use
of Miami Baseball Stadium

An Ordinance amending Subsection (B)
of Section 53-146 of the code of the
City of Miami, Florida, 1980 as
amended, governing tax on admissions
for use of Miami Baseball Stadium is
recommended by the Department of
Stadiums and Marinas.
Per this Ordinance amending Section 53-146, the tax on admissions
to the Miami Baseball Stadium for the use of the entire stadium
and field (for festival seating) has increased from 10% to 12% of
the gross admission price.
With the 2% increase on gross admissions, we (Stadiums and Marinas
Department) will provide traffic control and security on the out-
side of the stadium, before, during and after the event as part of
event services.
Security requirements vary based on the group or act and crowd
size. For the most part, the extra 2% will offset the cost of
security based on the following example: `
A concert with 28,000 fans will.generate $350,000
gross ticket revenue.
The 2% extra use fee on the above gross will pro-
duce $7,000.
Police costs estimated for this same event would
be $6,825.
The use rate of 12% is in line with rates charged at other sports
facilities holding rock concerts as follows:
Tampa Stadium 10%
Tangerine Bowl 10% to 12%
Gator Bowl 10%
All of the above rates include police security and traffic control.
