WHEREAS, the Florida Legislature has approved committee substitute for
Senate Bill 895; and
WHEREAS, said bill increases the previous cap on cities and counties
tort liability by one hundred percent (1001l;); and
WHEREAS, said increase will place an extreme financial burden on large
Self -insured cities; and
WHEREAS, the City of Miami, in order to comply with the legal ramifi-
cations of this increase will have to reduce City employees by the equivalent
of one hundred (100) positions; and
WHEREAS, the City of Miami has been required to reduce its CETA
positions by some one thousand (1,000) employees; and
WHEREAS, the City of Miami has a $10.3 million budget short -fall for
the fiscal year 1981-82; and
WHEREAS, S5.6 million of that budget short -fall is needed to hire
one hundred eighty-six (186) police officers to respond to the Greater Miami
area crime problem; and
WHEREAS, some five hundred (500) City employees will have to be laid
off in order to balance the City's budget; and
WHEREAS, this increased liability adds a great financial burden on the
taxpayers of Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. That Governor Robert D. Graham is hereby respectfully
requested to veto the committee substitute for Senate Bill 895 which increases
the City's liability from $50,000 to $100,000 for any claim or judgment and
from $100,000 to $$200,000 for each incident or occurrence which increase
would require the City of Miami to increase its self -insured reserve by approx-
imately $2,000,000 resulting in the reduction in number of s' ntrROd 1WISSiON )

office or employment under circumstances in which the state or
such agency or subdivision, if a private person, would be
liable to the claimant in accordance with the general- laws of
this state, may be prosecuted subject to the limitations
specified in this act. Any such action may be brought in the
county where the property in litigation is located or, if the
affected agency or subdivision has an office i„ such county
for the transaction of its customary business, where the cause
of action accrued.
(5) The state and its agencies and subdivisions shall
be liable for tort claims in the same manner and to the same
extent as a private individual under like circumstances, but
liability shall not include punitive damages or interest for
the period prior to judgment. Neither the state nor its
agencies or subdivisions shall be liable to pay a claim or a
judgment by any one person which exceeds the sum of $1OO,OOO
0697099 or any claim or judgment, or portions thereof, which,
when totaled with all other claims or judgments paid by the
state or its agencies or subdivisions arising out of the same
incident or occurrence, exceeds the sum of $200,000 6i66-666.
However, a judgment or judgments may be claimed and rendered
in excess of these amounts and may be settled and paid
pursuant to this act up to $100,000 or 5200,000, 666-666 of
ii667666; as the case may be, and that portion of the judgment
that exceeds these ancunts may be reported to the Legislature,
but may be paid in part cr in whole only by further act of the
Legislature. The limitations of liability set forth Jr, _',is

Although efforts are being made at the present time to convince the legislature
to pass at least a one-half cent (20 sales tax that would allocate funds to
county and municipal governments, the legislature did pass the Committee Substi-
tute for senate Bill 895 that could have an adverse impact on the City budget by
as much as $2,000,000 a year. This bill increases the legal limit for tort claims
against the City from $50,000 per claim to $100,000 per claim and for each incidence
or occurrence an increase from $100,000 to $200,000. This bill becomes effective
October 1, 1981 and relates only to those claims that are filed after that date. It
would not apply to any existing claims against the City.
There is presently a court suit which, if successful, would remove the cap and some
feel that if this legislation were allowed to become law that it may influence the
courts not to remove the cap. Any assessment of the effect that this law suit
might have on the removal of the cap should be made by the Law Department.
I have discussed this issue with Ray Sittig, Executive Director of the Florida
League of Cities and Seth Gordon of the County Manager's Office who lobbied to keep
the financial impact of this bill on cities and counties to a minimum. They will
be discussing the effect that this proposed law would have on city and county budgets
with the governor's office in an effort to keep this bill from becoming law.
Several other communities are being contacted to enlist their support in requesting
the Governor for a veto and explain the results that the implementation that the
law will have on local budgets. The City estimates that an additional $2,000,000
will be needed in our self-insurance reserve account to cover the increased exposure
resulting from the increased liability. To offset the increased budget requirement
for self-insurance the City would be required to reduce its personnel budget the
equivalent of 100 positions. The City has already lost approximately 1,000 employees
resulting from the loss of the CETA positions and may lose an additional 500 employees
in order to balance the budget.
The attached resolution requests the Governor to veto this bill and asks other munic-
ipalities and counties to join the City in this effort.

The purpose of this memorandum is to give you a briefsyn-
opsis of the law concerning municipal liability for sign
stubs on City sidewalks.
It has long been established in Florida that for a munici-
pality to be held liable for defects in sidewalks, it must
be shown that the City had actual knowledge thereof or that
such defects were open and obvious and had existed for
such a sufficient time that if the City had exercised
due care it should have known of its existence and remedied
it. In addition, the duty to repair and maintain City
streets and sidewalks rests solely upon the municipality
involved and such duty cannot be delegated to others so as
to absolve the City from liability for negligent performance
thereof. Singleton v. City of Jacksonville, 107 So.2d 47 (1
DCA, 1958).
Section 29-6.1
provides:
Metropolitan
Jurisdiction Declared Exclusive;
tampering with control devices pro-
hibited.
From and after September 16, 1960,
all traffic engineering services shall
be performed by the Traffic & Transpor-
tation Department, and such Department
shall have exclusive jurisdiction over
all traffic control devices in both
the incorporporated and unincorporated
areas of the County, and shall have
exclusive jurisdiction to exercise the
powers, duties, and functions set forth
herein. All municipalities in Dade
County are prohibited from exercising
any such powers, duties and functions,
and shall not interfere with the performance
thereof by said County Department.
It shall be unlawful for any person,
firm, Corporation, or other legal
entity, including municipal corpora
tions, to change, modify, install,
remove, damage, deface or destroy any
traffic control device, unless author-'
ized to do so by the Traffic & Trans
portation Department. (Ord. No. 60-25,
Section 9, 9-6-60).
It would appear that this ordinance would allocate at least
some of the liability for sign stub cases to Metropolitan
Dade County. However, due to the non -delegable character of
the City's duty to maintain City sidewalks, the Third District
Court of Appeal has indirectly determined that the City's
non -delegable duty to maintain City sidewalks overcomes the
County's duty to maintain its traffic control devices.
City of Miami v. Maldonado, 386 So.2d 586 (3 DCA, 1980).
More recently, despite the ruling in City of Miami v. Maldonado,
this office has been successful in convincing one Assis-
tant County Attorney that Metropolitan Dade County should
share the liability for persons injured as a result of sign
stubs located on City sidewalks. This office will continue
to pursue contribution from Dade County on these cases, until
unequivocally prohibited by a court of competent jurisdiction.
