HomeMy WebLinkAboutO-09289AN ORDINANCE AMENDING SECTION l OF ORDINANCE NO. 8835, ADOPTED .JULY 27, 1978, WHICH ESTAB- LtSHED A TRUST AND AGENCY FUND ENTITLED: "POLICE SECOND DOLLAR TRAINING",' BY INCREASING Tilt APPROPRIATION FOR SAID FUND IN TMt AMOUNT OF $38,556, FROM REVENUE RECEIVED FROM DADE COUNTY FOR FISCAL YEAR 1979-80 PURSUANT TO FLORIDA STATUTES, CHATTER 943:25(5) FOR THE PURPOSE OF PROVIDING LAW ENFORCEMENT TRAINING AND EDUCATION; CONTAINING A REPEALER PROVISION AND A SEVERA,- BILITY CLAUSE. WHEREAS, Ordinance No. 8835, adopted July 27y 1978, established a Trust and Agency Fund entitled: "Police Second Dollar Training" to receive funds for the purpose of providing law enforcement train- ing and education; and WHEREAS, Florida Statutes, Chapter 943.25(3) authorized the assessment of one dollar ($1.00) as an additional court cost against every person convicted for violation of a state penal or criminal statute or convicted for violation- of a municipal or county ordi- nance, and also $1.00 from every bond estreature or forfeited bail bond related to such penal statutes or penal ordinances and for payment for such funds into the State Treasury; and WHEREAS, Florida Statutes, Chapter 943.25(5) permitted muni- cipalities and counties to assess an additional $1.00, as aforesaid,_ for law enforcement officers; and authorized the aforesaid assess- ments to be "earmarked specifically for law enforcement training and educational purposes"; and provided for such funds to be credited on a pro-rata basis by the number of authorized sworn officers in duly authorized law enforcement agencies in Dade County at the com- mencement of each County budget year; and WHEREAS, revenues totalling $38,556 were rec:eived,from Dade' County for fiscal year 1979-80 and are .available to be appropriated into the City's ongoing "Police Second Dollar Training" Trust and Agency Fund, created by said Ordinance No, 8835, which fund presently includes a carry -oven fund balance of $26,042; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; f Section 1, Section 1 of Ordinance No, 88355 adopted July 27, 1978j which established a 'Trust and Agency Fund entitled: "Police Second Dollar Training" is hereby amended in the following particu- lars:r "Section 1� The following Trust and Agency Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Police Second Dollar Training RESOURCES: $1.00 additional assessment of court costs per State Statute 943,25 (3 and 5 ) 1) Received from Dade County FY'76-77 and FY'77-78 2) Received from Dade County FY'78-79 3) Received from Dade County FY'79-80 TOTAL RESOURCES: APPROPRIATION: $195;F93 $19576ea $132,650 $ 62,953 $ 38,556 $234,159 $234,159" Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remain- ing provisions of this ordinance shall not be affected. The distribution of these monies is provided for in Dade County Resolution No: 103--75 on a pro-rata basis by the number of sworn officers in authorized law enforcement agencies in Dade County at the commencement of each County budget year. These assessments are earmarked specifically for 'law enforcement training and educational purposes, such as recurring training, tuition and expenses at police academies, educational seminars and related education efforts for sworn personnel. The attached proposed ordinance increases the appropriation for the above mentioned Trust and Agency Fund by $38,556 to reflect revenues received from Dade County for FY 180 pursuant to Florida Statutes 943.25 (5).
