ATIONS ORDINANCE FOR FISCAL YEAR ENDING
SEPTEMBER 30, 1981, AS AI.IENDED, BY INCREASING
THE APPROPRIATION IN THE ENTERPRISE FUNDS, _
ORANGE BOGTL STADIUM TWO PERCENT (2%) RESORT
TAX BY AN AMOUNT OF $175,000 TO INSTALL
SECURITY FENCING AND GATES IN THE ORANGE BO1,TL
PARKING LOTS AND AROUND THE PERIMETER OF THE —
ORANGE BOWL PRIOR TO THE 1981 FOOTBALL SEASON;
CONTAINING A REPEALER PROVISION AND A SEVER. -
ABILITY CLAUSE. _
t:'HEREAS, the City Commission adopted Ordinance No. 9199
on November 6, 1980, establishing resources and appropriations
for the implementation of Capital Improvements in the City of
i•:iami, Florida for the fiscal year ending September 30, 1981;
and
WHEREAS, the Orange Bowl has been experiencing increas-
ing levels of vandalism and theft in recent years during periods
when it is not in use; and
tv'HEREAS, it has been determined that the best solution to
this situation would be to erect an inner perimeter security fence;
and
WHEREAS, the cost of installing said security fence is
estimated to be $175,000; and
VTHEREAS, the County Commission has approved the payment
of Resort Tax monies to the Orange Bowl to provide for the repay-
ment of the aforementioned amount over a period of 18 months; and

of $175,000, from the Florida Power and Light Franchise Revenues
to the Orange Bowl Enterprise Fund:

Section 2. The herein appropriation of $175,000
from the Orange Bowl Stadium Enterprise Fund, 27, Resort
Tax Fund, is made for the purpose of providing funding
for security fence and gates at the Orange Bowl.
,Section 3. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
Section 4. If any section, part of section,
paragraph, clause, phrase, or word of this ordinance is
declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 5. This ordinance is hereby declared to
be an emergency measure on the grounds of urgent public
need for the preservation of peace, health, safety, and
property of the City of Miami, and upon the further
ground of the necessity to make the required and necessary
payments to its employees and officers, payment of its
contracts, payment of interest and principal on its debts,
necessary and required purchases of goods and supplies,
and to generally carry on the functions and duties of its
municipal affairs.

Bowl Enterprise Fund & Companion =-
Ordinance Amending the Capital
Improvement Appropriation Ordin-
ance.

The Department of Stadiums and Marinas
recommends the adoption of a resolution
authorizing the loan of $175,000 from
Florida Power and Light Franchise Reve-
nues, in the Capital Improvement Fund,
to the Orange Bowl Enterprise Fund, for
the purpose of installing security fencing
and gates in the Orange Bowl parking lots
and around the perimeter of the Orange
Bowl; the said sum of $175,000 to be re-
paid from the 2% Resort Tax over a period
of 18 months; with interest at 13.04 % to
be repaid from the Orange Bowl Enterprise
Fund.
The enclosed Companion Ordinance amending the Capital Improvement
Appropriation Ordinance establishes a new project in the Orange
Bowl Enterprise Fund by increasing the appropriation of the Orange
Bowl 27 Resort tax in an amount of $175,000.
The Orange Bowl has been experiencing increasing levels of vandalism
and theft in recent years, during periods when it is not in use.
After consideration of a variety of options, we have concluded that
the best solution to this situation would be to erect an inner perim-
eter security fence. This has been done at a number of other major
stadiums, and we are advised by the operators of those stadiums that
it has been highly successful as a solution to the problem.
The Tourist Development Council and the Dade County Commission have
committed an estimated $175,000 from future collections of the Orange
Bowl portion of Resort Tax funds so that we may purchase and install
the aforementioned security fence and to purchase and install new posts
_ and security gates of all Orange Bowl ;parking lots.
