A RESOLUTION CLOSING, VACATING, ABANDONING
AND DISCONTINUING THE PUBLIC USE OF THAT
PORTION OF RICE STREET LOCATED SOUTH OF THE
SOUTHERLY RIGHT-OF-WAY LINE OF FLORIDA AVENUE
AND NORTH OF THE NORTHERLY RIGHT-OF-WAY LINE
OF GRAND AVENUE, FOR A DISTANCE OF + 277.28',
AS PER TENTATIVE PLAT NO. 1129 "MAYFAIR SUB-
DIVISION"; SUBJECT TO THE PROVISIONS DETAILED
IN THE LETTERS ON FILE DATED JULY 6, 1981,
FROM KENNETH TREISTER AND FROM EUGENE L.
SIMM, DIRECTOR, DEPARTMENT OF TRAFFIC AND
TRANSPORTATION, ATTACHED TO AND MADE A PART
OF THIS RESOLUTION; ALSO SUBJECT TO CITIZEN'S
INPUT, AND ACKNOWLEDGING RECEIPT OF A VOLUNTARY
COVENANT FILED BY APPLICANT IN CONNECTION HEREWITH.
WHEREAS, the Miami Zoning Board at its meeting of July
6, 1981, following an advertised hearing, adopted Resolution
No. ZB 124-81 by a 5 to 1 vote RECOMMENDING vacation and closure
of a portion of Rice Street, as hereinafter set forth; and
WHEREAS, the City Commission deems it advisable and
in the best interest of the general welfare of the City of Miami
and its inhabitants to grant the vacation and closure of that
said portion of the street in question:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That portion of Rice Street located south
of the southerly right-of-way line of Florida Avenue and north
of the northerly right-of-way line of Grand Avenue, for a distance
of + 277.28', as per Tentative Plat No.1129 "MAYFAIR SUBDIVISION";
subject to the provisions detailed in the letters on file dated
July 6, 1981, from Kenneth Treister and from Eugene L. Simm,
Director, Department of Traffic and Transportation, attached to
and made a part of this Resolution; also subject to citizen's input,
be and the same is hereby closed, vacated, abandoned and discontinued
for public use.

I am writing to support the position of Mr. Treister and Mr.
Garfield regarding the closing of the southern part of Rice
Street and making it a pedestrian walk -way which I know will
upgrade the area, as all of their projects have.
I live in the south end of the Grove and my business is here
in Coconut Grove and I think.this type of improvement is
necessary for the businesses of Coconut Grove and will
continue the upward transition in the area.
I hope to be at the meeting this Thursday night, July 23rd,
but if I am detained, I hope this letter will be helpful in
,my absence. „

Dear Mayor:
We are the owners and developers of Grove Towers Condominium,.
on Bayshore Drive and Mary Street.
We would like to go on record as strongly supporting the
proposed conversion of a portion of Rice Street from e
vehicular street to a pedestrian mall. The future residents
of our building obviously are attracted to Coconut Grove
because of the pedestrian oriented village center and we
feel that this pedestrian street will further enhance that
unique quality that has made the Grove a special place.
The developers of Mayfair have created a beautiful development
and we are confident that the new pedestrian street will
continue that tradition of high quality and static beauty.
The traffic flow, by the closing of Rice Street, should not
affect the area because Rice Street is not one of the major
arteries.
In summary, we fell this pedestrian mall will be a positive
addition to our community.

between Florida and Grand Avenues provided an additional southbound
approach storage lane is developed along Mary Street north of Grand
Avenue at the developer's expense.
Should traffic generation and patterns, influenced by the street
closure and Mayfair expansion, warrant signalization of Grand and Mary
Street at a later date, we would expect the cost of signalization to
be borne by the developer.
This Department will work with the Grove community to enhance motorist
information signing toward the Village Center and, coordinate efforts
to improve circulation patterns, parking, and other curb uses.

Dear Dick:
This is to verify that we will submit the final designs to the City's
Public Works, Planning and Building Departments for their approval prior to
the commencement of detailed working drawings and construction.
We have clarified our designs and are now contemplating construction of two
public fountains that will not conflict with the underground utilities presently
in Rice Street.
We would also like to state that if any repairs are needed to the underground
utilities in the City's easements, we will repair the pavement or other amenities
effected by these repairs at our cost.
We have also provided a vehicular path for emergency vehicles though the fire
and rescue departments said one is not needed.
We will include a covenant that the pedestrian street will be open to the public
at all times. We plan to keep Rice Street visually open through its length and
will limit the two overhead bridges that we proposed,to an agreed percentage of the
street so as to assure that the majority of the street will be open to light and
air.
In addition, we have agreed to pay for the improvements at Mary Street as it
intersects Grand Avenue for the addition of a third lane.
We thank you for your consideration of our proposal and look forward to working
with you on the creating of a pedestrian street that will be an asset to the
village of Coconut Grove and the City of Miami.

I am writing this letter to express my support of the
application of Ken Treister and Joseph Garfield to create
a pedestrian mall on Rice Street.
I feel that the past efforts of the developers have been
beneficial to the residents and business interests of the
Grove area. In view of their investment and successful
development record, I am sure the results of this effort
would also be beneficial to the Grove.
In simple terms, they are trying to create a development
with a strong regional attraction that will have a long
term beneficial effect on the Grove and will far out -weigh
any real or imagined adverse effect on the traffic flow in
the area, since almost no one ever uses Rice Street anyway.

At the end of the zoning hearing in reference to converting Rice Street in
Coconut Grove to a pedestrian mall, I understood that the approval was still
partly subject to further input from interested people within the neighbor-
hood.
Expecting that most of your response will be against this project, I an
writing to urge approval. I an interested in this because I live in one of
the apartments at Yacht Harbour Condominium which overlooks Mayfair and Rice
Street.
During the hearings, most of the objectors were simply voicing complaints
about general traffic conditions in the vicinity and about how the character
of Coconut Grove is changing. The objections were not specifically to the
point, which is whether or not Rice Street should be converted to a land-
scaped pedestrian street, or retained for automobile use. In general, they
were simply against any changes and using the hearing as an opportunity to
voice complaints about non -related personal inconveniences they have suf--
f Bred.
To retain the street as it now stands means it will be used mostly for parkipg
cars along both sides. The street is only two blocks long and is not In
Itself going to affect the total amount of traffic in the area either wayl
New buildings being built will, of course, increase traffic, but keeping Rice`.,
Street open should have little effect on the traffic congestion which will oc-
cur on Mary and Grant Avenue.

A walking pedestrian mall is a very pleasant type of amenity which is sorely
needed in Coconut Grove, where people tend to enjoy walking. This is readily
evidenced on Main Street and Commodore Plaza, and such a pedestrian mall is
bound to be very popular, even among those who are presently objecting.

Progressive and well planned changes such as this tend to preserve and upgrade
a neighborhood. To do nothing means to let a neighborhood run down. Coconut.
Grove was suffering in general from a run dawn condition until a few short
years ago. As neighborhoods run down, undesirable elements move in and
property values (and the City's tax base) decline.
I hope this letter will be helpful in leading to a favorable final decision
and resulting in the conversion of Mice Street into the attractive pedestrian
mall which is envisioned&
