A RESOLUTION AUTHORIZING MIAMI-DADE COMMUNITY
COLLEGE, NEW WORLD CENTER CAMPUS, THE USE OF
MIAMI BASEBALL STADIUM FOR BASEBALL PRACTICE
SESSIONS OR THE PLAYING OF REGULAR BASEBALL t
GAMES ; WAIVING THE NORMAL USE FEE; REQUIRING PAYMENT OF `F
ANY COSTS; AND AUTHORIZING THE CITY MANAGER
TO ENTER INTO AN AGREEMENT REFLECTING THE "=
TERMS AND CONDITIONS OF THIS RESOLUTION.
WHEREAS, Miami -Dade Community College, New World Center Campus, has no access

to baseball facilities in which to conduct its baseball practice sessions or play
regular games; and
WHEREAS, the City owns and operates the Miami Baseball Stadium which is a
desirable location for meeting the College's needs; and
WHEREAS, the City, through a harmonious relationship with the College, is
supportive in the development of the baseball program of the College;
NOW, THEREFORE, be it resolved by the Commission of the City of Miami,
Florida:
Section 1. The use of the Miami Baseball Stadium for holding practice and
games from September 8, 1981, through and including November 13, 1981, is hereby
granted to Miami -Dade Community College, New World Center Campus at no charge.
The College has agreed to pay all costs incidental to holding its practices
or games at Miami Baseball Stadium.
Section 2. The City Manager is authorized to enter into an Agreement
reflebting the terms and conditions of this resolution.
Passed and adopted this 23rd day of July 1981.

A G R E E M E N T
This Agreement entered into this day of , 1981 by and
between the MIAMI-DADE COMMUNITY COLLEGE, NEW WORLD CENTER CAMPUS, hereinafter
referred to as the "Lessee", and the CITY OF MIAMI, a municipal corporation of
the State of Florida, hereinafter referred to as the "City".
W I T N E S S E T H:
WHEREAS, the Lessee currently has no access to a facility in which to
conduct its baseball practice sessions or play regular games; and
WHEREAS, the City is desirous of fostering harmonious .relationships with
the Lessee; and
WHEREAS, the City is interested in supporting the development of the
athletic program of the Lessee,
NOW, THEREFORE, in consideration of the premises and the mutual covenants
as herein contained, the parties agree as follows:
A. TERM
The term of this Agreement shall be from September 8, 1981, through and
including November 13, 1981.
B. USE
The lessee is hereby authorized to use the City facility known as the
Miami Baseball Stadium, for the purpose of conducting baseball practice sessions
from 2:00 P.M. until 4:00 P.M. and/or games starting at 3:00 P.M. until conclusion.

All events will take place Monday through Friday. There will be no weekend or
evening play scheduled.
C. LIMITATIONS
The Lessee understands and agrees that the use of the Stadium is subject'
to any use contemplated by the City on any given day during the term of this
Agreement, and the lessee further agrees to forego the conduct of any practice
sessions or regular games scheduled on any day(s) the Stadium's Manager advises
that there is another use scheduled for the Stadium on such day(s), or on any
day(s) when use by Miami Dade Community College will interfere with the field
maintenance operation by the City. Said decision shall be made at the sole
discretion of the City without any right of appeal by the Lessee.

The Lessee agrees that the fee for the use of the Miami Baseball
Stadium shall be the payment for any services rendered by an employee of
the City beyond the normal working day at a rate of Ten Dollars ($10.00) per
hour, payable directly to the employee at two week intervals beginning with
the start of the contemplated use by the Lessee.
E. INSURANCE
That the Lessee shall obtain at its sole cost and expense liability
insurance in the amounts applicable under Florida Statutes for each occurrence
and per person for judgements entered against the Lessee and the City shall be
one of the named insured in the policy. The policy of insurance shall provide
that the City be given at least thirty (30) days advance written notice of
cancellation of said police. A certificate of insurance shall be provided to
the City prior to the execution of this Agreement. The insurance coverage
required herein shall be reviewed and approved by the City's Director of the
Division of Property Management. This coverage shall be consistent with the
terms of 768.28. Florida Statutes.
F. INDEMNIFICATION
The Lessee covenants and agrees that it shall indemnify, hold harmless,
and defend the Lessor from and against any and all claims, suits, actions,
damages, or causes of action arising during the term of this lease Agreement,
in or about the leased premises by reason of or as a result of Lessee's
occupancy or use thereof.
G. TERMINATION
The Lessee agrees that it will perform and abide by all of the terms
and covenants of this lease Agreement. In the event of any breach of any such
term or covenant, the Lessor may terminate this lease Agreement upon 30 days
written notice. The lease may be terminated by the Lessee at any time upon
written notice.

At present Miami-Dade's New World Center Campus located in Downtown Miami has~
no baseball practice or playing facilities.
In the past, the City Commission of the City of Miami has
granted the use of
Miami Baseball Stadium at no charge, provided that Miami -Dade did not interfere
with any other activities scheduled or to be scheduled at
the stadium.
Miami -Dade has agreed to pay for any expenses incidental to holding their
practices or games in the stadium.
The Department of Stadiums and Marinas recommends the use
of Miami Baseball
Stadium for the above stated purpose.
