HomeMy WebLinkAboutR-81-0671RESOLUTION N*t9j a87 1 A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE ACTION OF THE CITY MANAGER IN ENTERING INTO THE ATTACHED AGREEMENT WITH THE PUBLIC HEALTH TRUST OF DADE COUNTY, FLORIDA, WHICH OPERATES JACKSON MEMORIAL HOSPITAL, AND THE UNIVERSITY OF MIAMI, FOR THE COORDINATION OF EMERGENCY MEDICAL SERVICES, PROVIDED BY THE RESCUE DIVISION OF THE CITY OF MIAMI FIRE DEPARTMENT, IN ACCORDANCE WITH THE TERMS AND CONDITIONS SET FORTH THEREIN; WITH FUNDS THEREFOR IN THE AMOUNT OF $10,000 ALLOCATED FROM THE FIRE DEPARTMENT'S GENERAL OPERATING BUDGET. WHEREAS, the City of Miami, the Public Health Trust of Dade County, Florida, and the University of Miami desire to cooperate to provide services in connection with the Emergency Medical Ser- vices provided by the Rescue Division of the City of Miami Fire Department; and WHEREAS, funds are available in the Fire Department's General Operating Budget; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The action of the City Manager in entering into the attached Agreement with the Public Health Trust of Dade County, Florida, and the University of Miami for the coordination of the Emergency Medical Services provided by the Rescue Division of the City of Miami Fire Department, in accordance with the terms and conditions set forth therein, is hereby ratified, approved and confirmed, with funds therefor in the amount of $10,000 hereby allocated from the Fire Department's General Operating Budget. Ferre M A Y 0 R CITY COMMISSION MEETING OF JUL3 3 1981 N oww" Nag 1 6 7 A AGREEMEN-T BETWEEN CITY OF MIAMI AND UNIVERSITY OF MIAMI AND PUBLIC HEALTH TRUST OF DADE COUNTY, FLORIDA THIS AGREEMENT, entered into this day of �r�` , 19, by and betweeen the City of Miami, a mucorporation -of the State Of Flori a, (hereinafter referred to as the "CITY") the Public Health Trust of Dade County, Florida, an agency and instrumentality of Dade County, Florida (hereinafter referred to as the "TRUST") which operates Jackson Memorial Hospital (hereinafter referred to as "HOSPITAL"), and the University of Miami (hereinafter referred to as the "UNIVERSITY"). W I T N E S S E T H WHEREAS, the CITY, the TRUST, and the UNIVERSITY desire to cooperate to provide certain services in connection with the Emergency Medical Services provided by the Rescue Division, City of Miami Fire Department. NOW THEREFORE, inconsideration of the promises and the mutual covenants and agreements herein contained, the parties hereto agree as follows: A. The TRUST agrees: 1. To provide support in the form of licensed house staff members from HOSPITAL, each of whom is qualified to practice medicine at HOSPITAL and is fluent in the English language. Said physicians will be available on a 24-hour basis for prompt response to emergency medical radio transmissions from CITY Fire Department Rescue Units. 2. ' To support the Medical Director by providing the resources and facilities to provide training for system paramedics. B. The UNIVERSITY agrees: 1. To providea qualified Medical Director, acceptable to the CITY and TRUST, to provide support in accordance with State of Florida laws and regulations to the Emergency Medical System of the CITY. Said Medical Director (or his alternate, as provided for in paragraph B.2.) shall supervise house staff members of HOSPITAL who are provided by the TRUST for prompt response to emergency medical radio transmissions from CITY Fire Department Rescue Units. 2. To provide alternate physicians, acceptable to the Medical Director, TRUST, and to CITY, in order to endeavor to insure that qualified relief supervision is always provided during the Medical Director's absence from the system. 4. That the Medical Director and his alternates shall be fluent in the English language and qualified to practice medicine at HOSPITAL. 5. To provide legal services as may be required by the Medical Director • in the performance of his responsibilities. C. The CITY agrees: 1. To pay to the UNIVERSITY as compensation for services, the annual sum of Ten Thousand Dollars ($10,000.00) payable in equal quarterly installments, to be used as deemed appropriate by the UNIVERSITY. 2. That all paramedical personnel assigned to advanced life support vehicles will be approved by the Medical Director and the Fire Chief of the Rescue Division. 3. To provide to the Medical Director a list of equipment carried on the advanced life support vehicles which list shall be in accordance with the equipment required by regulations of the Department of Health and Rehabilitative Services and the State of Florida Statutes 401. 4. To carry said equipment on all fire rescue vehicles used. In the event that the Medical Director determines that the equipment listed does not meet the requirements of the regulations, the CITY agrees that it will immediately take the necessary action to bring the equipment carried on the advanced life support vehicles into compliance with the regulations. D. All parties agree that: 1. The CITY, as allowed by law, shall indemnify and hold harmless the UNIVERSITY, Dade County and the TRUST against any and all liabilities arising out of the negligence by employees and/or personnel of the CITY which may arise during the period that care, custody and control of a patient is in the hands of a rescue squad of the Rescue Division and, at its own cost and expenses shall defend Dade County, the UNIVERSITY, the TRUST, and any of their respective officers, trustees or employees,,against any such claim brought against any of them. 2. The UNIVERSITY agrees to indemnify and hold harmless the CITY, Dade County and the TRUST against any and all liabilities arising out of the negligence by employees and/or personnel of the UNIVERSITY which may arise during the period that care, custody and control of•a patient is in the hands of a rescue squad of the Rescue Division and at its own cost and expense, shall defend the CITY, Dade County, and TRUST and any of their respective officers, trustees or employees against any such claim brought against any of them. - page 2of4- Agreement with City of MianflNd University of Miami-=EWPAY'dieal Serwite provided by Rescue Division, City of Miami Fire Depb, gent. It is further provided that in no event shall the agents, contractors, officers, servants or employees of the CITY be considered to be agents, officers, servants or employees of the TRUST or UNIVERSITY. It is further provided that in no event shall the agents, contractors, officers, servants or employees of the TRUST or UNIVERSITY be considered to be agents, officers, servants or employees of the CITY. 5. All parties will comply with Florida Statutes, Sections 401.21 through 401.47 and the implementing regulations promulgated by the Department of Health and Rehabilitative Services. 6. That this Agreement shall commence on July 1, 1981 and shall terminate on June 30, 1982; provided however, that any party may cancel the Agreement by giving sixty (60) days notice in writing to all other parties by certified mail, return receipt requested. Notice is effective upon receipt. 7. Brice, Director Department of Fire DATE July 90 1881 PILE SUBJEc r Agenda Item for City Ctauiasion Meeting of July 23, 198.1., REFERENCES ENC;LOSUPF.S Resolution It is recommended that the City Commission ratify ¢: the action of the City Manager in entering into o•' an Agreement with the Public Health Trust of Dade County which operates Jackson Memorial Hospitalf and the University of Miami for the coordination of Emergency Medical Services, substantially in accordance with the terms and conditions set forth - in the attached Agreement; with funds allocated in the Fire Department's General Operations Budget, as per the attached Resolution. The Agreement forwarded herewith is a continuation of the Emergency Rescue Agreement which expires on June 30, 1981, in which the University of Miami provides a qualified Medical Director to supervise house staff members at Jackson Memorial Hospital in their response to our Rescue Units' radio transmissions. The new Agreement is for one (1) year, commencing July 1, 1981. The annual compensation under this Agreement remains at $10,000, to be paid in quarterly installments. This sum is included in the Fire Department's annual general operating budget. The Law Department has reviewed this Agreement and it has been executed by by all parties concerned.
