HomeMy WebLinkAboutO-092984 ORDINANCE NO. 9 R AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 92671 ADOPTED MAY 15, 1981, WHICH ESTABLISHED A TRUST AND AGENCY FUND ENTITLEdt "CABLE TELEVISION", BY INCREASING THE APPROPRIATION FOR SAID FUND IN THE AMOUNT OF $25,000, FROM REVENUE RECEIVED FROM CABLE TELL - VISION COMPANIES IN THE FORM OF A NONREFUNDABLE BIDDING FEE; 'CON- TAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE: AND OIS- PENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. ■ WHEREAS, the City Commission adopted Resolution No. 81=291 on April 9, 1981 authorizing the City Manager to enter into an agreement with Telecommunications Management Corporation (TMC), based upon said firm's letter dated February 11, 1981, to evaluate cable television proposals to be received by the City of Miami on or before April 10, 1981; and WHEREAS, said resolution authorized the allocation of up to $50,000 from funds generated from nonrefundable application fees to be paid by the applicants; and WHEREAS, in response to the request for proposals to provide cable television services to the City of Miami five (5) cable television companies each submitted proposals along with a $10,000 nonrefundable application fee by the deadline of 2:00 p.m., Friday, April 10. 1981; and WHEREAS, said Resolution No. 80-888 stated that the application fee will be used to pay the costs relating to the preparation, advertising, receiving, evaluating and awarding of a Cable Television License in the City of Miami; and WHEREAS, the City Commission adopted Ordinance No. 9267 on May 15, 1981'' establishing a Trust and Agency Fund entitled "Cable Television" andappropriated thereto a sum of $25,000; and WHEREAS, the City Commission has selected a cable company with whom to negotiate a cable television license agreement; and WHEREAS, the City Commission has authorized the City Manager to enter into an agreement with Telecommunications Management Corporation (TMC) for purpose negotiating ense agreement; and the ur ose of ne ot�atin said cable television tic WHEREAS, an appropriation of $25,000 remaining from the $50,000 cable license application fees is needed to cover the costs of negotiating and awarding a cable television license in the City of Miami; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY Op MIAMI, FLORIDA: Section 1, Section 1 of Ordinance No, 9261, adopted May 15, 1981, 1/ is hereby amended in the following particulars: "Section 1. The following trust and Agency Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Cable Television RESOURCES: Cable Television Nonrefundable Bidding Fees $291990 $50,000 APPROPRIATION: Cable Television $25,999 $50,000" Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. On April 9, 1981 the City Commission adopted Resolution No. 81-291 authorizing the City Manager to enter into an agreement with Telecommunications Management Corpora- tion (TMC) to evaluate cable television proposals and further authorized the alloca- tion of up to $50,000 in funds which were generated from the $10,000 nonrefundable application fee paid by each of the five companies proposing to provide cable tele- vision services to the City of Miami. On May 15, 1981 the Commission adopted Ordinance No. 9267 establishing a trust and agency fund entitled "Cable Television" and appropriated thereto a sum of $25,000 being a portion of the $50,000 paid to the City by the cable television applicants. On July 14, 1981 the City Commission adopted Motion No. M-81-646 authorizing the City (Manager to enter into an agreement with Mr. Carl Pilnick for the purpose of assisting the City in negotiating a contract with Americable of Greater Miami to supply cable television services to the City of Miami. Also the City Attorney will interview an appropriate attorney who will assist in the negotiation process. These• funds will be needed to pay for the expenses incurred in the cable television licensing negotiations.
