HomeMy WebLinkAboutO-09295ORDINANCE NO, 9 9 + AN ORDINANCE PROVIDING FOR T88 HOLDING OP A BOND ELECTION IN THE CITY OF MIAMI, PLORIDA; ON NOVEMBER 3, 1981t WITH RE- SPECT TO THE ISSUANCE OF W tOOOtOOO FIRE FIGHTINCr FIRE PREVENTION AND RESCUE FACILITIES BONDS; PROVIDING THAT THIS -_ ORDINANCE SHALL CO INTO EFPECT IMMEDIATELY i UPON ITS PASSAGE; AND DISPENSING WITH THE READING OF T81S ORDINANCE ON TWO SEPARATE DAYS BY A MOTE OF NOT LESS THAN FOURr-FIFTHS OF THE COMMISSION. t BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1: Notice of the bond election heretofore called by Ordinance No. 9296 to be held on Tuesday, November 3, 1981, shall be published in THE MIAMI HERALD and THE MIAMI NEWS and in , newspapers of general circulation published in The City of Miami, Florida, at least twice, once in the fifth week and once in the third week prior to the week in which said election is to be held, the date of the,first publication in each of said newspapers to be at least 30 days before said election, which notice shall be substantially in the following form: NOTICE OF BOND ELECTION _ To Be Held On TUESDAY, NOVEMBER 3, 1981 in THE CITY OF MIAMI, FLORIDA As provided by Ordinance, No. 9296 , duly adopted by the Commission of The City of Miami, Florida, an election will be held on Tuesday, November 3, 1981 for the purpose of submitting to the qualified electors of The City of Miami, Florida, the following question: MR III Shall bonds of The City of Miami, Plorida, ih a an aggregate principal amount not exceeding $21 000,000 be issued under the provisions of Ordinance No 9296..for the purpose of paying the cost of ;iRE FI(IRTINOO PIR9 RR9VtNTION �e ANb RES= FACILITIES in said City, such bonds to be issued at one time or from time to time and to mature its annual installments 3 to 20 years, inclusive+ after the date of the respective bonds, to bear interest at a rate or rates not to exCeed : the rate legally permitted and to be payable from unlimited ad valorem taxes, Such ordinance provides that for the prompt payment -_ of the principal of and the interest on such bonds there shall be levied and collected annually an ad valorem tax - upon all taxable property within The City of Miami, over and above all other taxes authorized to be levied by said City, sufficient to pay such principal and interest as the same respectively become due and payable. The Commission of The City of Miami reserves the right to make all or any part of such bonds redeemable prior to their respective maturities at such times and prices and under such terms and conditions as may be fixed by resolu- tion prior to the sale of the bonds. The polls at said election will be open from 7:00 o'clock A.M. until 7:00 P.M. of the same day. The City of Miami shall be authorized to issue said bonds if the question for the issuance of said bonds shall be approved by a majority of the votes cast by the qualified electors of The City of Miami voting on such question. Said bond election shall be held at the polling places in The City of Miami, in the several election precincts designated by the Board of County Commissioners of Dade County, as set forth in the attached pages designated "POLLING PLACES IN THE CITY OF MIAMI". I gedtion �i A description of the registration books and records which pertain to eledtion precincts Wholly or partially within The City of Miami and which the City is adopting and desires to use for holding such special bond election is as follows! All registration cards; books, records and certificates pertaining to electors of The City of Miami and established and maintained as official by the Supervisor of Elections of Dade County, in conformity with the provisions of the general laws of The State of Florida, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of such City. Section 3. Since The City of Miami has established the permanent registration system under State law and the general election laws of the State require 14 days prior approval by the Board of County Commissioners of Dade County for acceptance of branch office registration and that the registration books be closed 30 days prior to the date of such bond election, registration for such bond election shall be at the office of the Supervisor of Elections of Dade County, 1400 Biscayne Boulevard, Miami, Florida. Section 4. Said bond election shall be held at the polling places in the several precincts, respectively, in the City as set forth in the foregoing NOTICE OF BOND ELECTION. Not fewer than 20 days before said election, the City Commission shall designate the Inspectors of Election and Clerk of Election for each precinct and shall publish the names of such Inspectors of Election and Clerks of 51 Election in a newspaper of qbhetal Circulation published in the City of Miami at least 15 days before the date of election. Section 5, All qualified electors of the City shall be permitted to vote in said bond election, and the Super- visor of Elections of bade County is hereby requested, au- thorized and directed to furni8he at the Cost and expense of The City of Miami, a list of all qualified electors residing in The City of Miami as shown by the registration books and records of his office, and duly to certify the same for delivery to and use of the election officials designated to serve at the respective polling places in said election precincts. Section 6. The City Clerk of The City of Miami is hereby designated and appointed as the official representa- tive of the Commission of the City in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said bond election. Section 7. The ballot used in said election for voting on the question submitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which will contain a statement of the question submitted, and said voting machines shall provide facilities for all qualified electors to vote for or against such question as they may choose. Said ballot as it appears within the first row of horizontal ballot frames of the voting machines shall be substantially in the following form: 6. In the event a mechanical voting machine shall not be used in voting on the question and an electronic or electromechanical vot- ing system is used in voting on the question, the question submitted shall be the same as provided above. Section 8. If a mechanical voting machine is used, each elec- tor desiring to vote for the issuance of said bonds shall be instruc- ted to turn down the pointer or lever over the word "FOR" within the ballot frame containing the statement of the question relating to such bonds, and each elector desiring to vote against the issuance of said bonds shall be instructed to turn down the pointer or lever over the word "AGAINST" within the ballot frame containing the statement of the question relating to such bonds. If an electronic or electromagnetic voting system is used, electors desiring to vote for the issuance of said bonds shall be instructed to punch straight down with the stylus through the hole next to the word "FOR" within the ballot frame containing the statement of the question relating to such bonds, and each elec- tor desiring to vate'against the issuance of said bonds shall be instructed to push straight down with the stylus through the hole next to the word "AGAINST" within the ballot frame containing the statement of the question relating.to such bonds, 7. This ordinance shall go into effect immediately upon its passage and shall not be subject to the right of referen- dum as an ordinance. Section 11. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission of the City of Miami. ORDINANCE NO, 9306 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 9199, ADOPTED NOVEMBER 6, 1980, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30,' 1981, AS AMENDED BY INCREASING THE APPROPRIATION FOR SUBSECTION XV, PARKING CAPITAL PROJECTS FUND.TO ESTABLISH FUNDING IN THE AMOUNT.
