HomeMy WebLinkAboutR-81-0783w t `7 RESOLUTION NO. 81 - 7 83 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO MARIA VEGA, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF TEN THOUSAND FORTY-ONE DOLLARS AND 50/100 ($10,041.50) IN FULL AND COMPLETE SETTLE- MENT OF ALL BODILY INJURY, PERSONAL INJURY PROTECTION LIENS, AND WORKMEN'S COMPENSATION LIENS, ALL CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, AND UPON EX- ECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, MARIA VEGA, through her attorney, Edward P. Busch, filed a claim against the City of Miami and alleged bodily injury, personal injury protection liens, and Workmen's Compensation liens, resulting from an accident that occurred on January 16, 1976 at or near 114 Northwest 44th Avenue, in the City of Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's Office in accordance with Ordinance # 8417, which created the City of Miami Self -Insurance Program, that said office recommends that this claim be settled for the sum of Ten Thousand Forty - One Dollars and 50/100 ($10,041.50); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Director of Finance is hereby authorized to pay to MARIA VEGA, without the admission of liability, tr- sum of Ten Thousand Forty -One Dollars and 50/100 ($10 "..50) in full and complete settlement of all bodily injury, personal injury protection liens, and Work- men's Compensation liens, all claims and demands against the City of Miami, by any parties, upon the execution of a release, releasing the City of Miami from all bodily injury, personal injury protection liens, Workmen's Compensation liens, all claims and demands. The City of &/;4� Miami Circuit Court Case # 77-4490(05) FROM George F. Knox, Jr. REFERENCES _ City Attorney ENCLOSURES - This claim arose from an accident in which Maria Vega tripped and fell on a defect on the sidewalk at 114 North- west 44th Avenue, Miami, Florida. The ownership and con- dition of the sidewalk have been verified and the responsi- bility rests with the City of Miami. As a result of the accident, Maria Vega, suffered medical expenses in the amount of $5,260.90. She suffered (1) a colles fracture of the left wrist with an associated _ fracture of the ulnar styloid, (2) a severely comminuted fracture of the distal humerus with splitting of the shaft of the condylar fragments, and (3) an impacted fracture of the left humeral neck. The court appointed physician, Leon H. Mims, determined that she has sustained a permanent partial disability as a result of the various fractures. Medical expenses and other items of damages have been veri- fied. After extensive settlement discussions and negotiations, _ it has been determined that the matter can be settled for $10,001.00, plus $40.50 in costs. The above claim has been investigated by the City Attorney's Office and in accordance with Ordinance #8417 which created the City of Miami Self -Insurance Program, we recommend that the attached Resolution be adopted authorizing payment in the amount of $10,041.50.
