A RESOLUTION MAKING PROVISIONS FOR HOLDING A
NONPARTISAN PRIMARY ELECTION FOR THE NOMINA-
TION OF CANDIDATES FOR THE OFFICES OF MAYOR
AND TWO COMMISSIONERS AND FOR HOLDING A LATER
GENERAL MUNICIPAL ELECTION UNLESS ALL OF SAID
OFFICES HAVE BEEN FILLED IN THE NONPARTISAN
PRIMARY ELECTION; PROVIDING FOR THE REGISTRATION
OF PERSONS QUALIFIED TO VOTE IN SAID NONPARTISAN
GENERAL ELECTION; DESCRIBING PERSONS QUALIFIED TO
VOTE IN SAID NONPARTISAN PRIMARY ELECTION AND
GENERAL ELECTION; DESCRIBING THE REGISTRATION BOOKS
AND RECORDS MAINTAINED UNDER THE PROVISIONS OF THE
GENERAL LAWS OF FLORIDA AND CHAPTER 16 OF THE CODE
OF THE CITY OF MIAMI WHICH THE CITY HAS ADOPTED
AND DESIRES TO USE FOR HOLDING SUCH NONPARTISAN
PRIMARY ELECTION AND SUCH GENERAL MUNICIPAL ELECTION;
DESIGNATING AND APPOINTING THE CITY CLERK AS THE
OFFICIAL REPRESENTATIVE OF THE CITY COMMISSION
WITH RESPECT TO THE USE OF SUCH REGISTRATION
BOOKS AND RECORDS; DIRECTING THE CITY CLERK TO
GIVE NOTICE BY PUBLICATION OF THE ADOPTION OF
THIS RESOLUTION AND OF THE PROVISIONS HEREOF;
DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED
COPY HEREOF TO BE DELIVERED TO THE SUPERVISOR
OF ELECTIONS OF DADE COUNTY NOT LESS THAN FORTY-
FIVE DAYS PRIOR TO THE DATE OF SUCH NONPARTISAN
PRIMARY ELECTION.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. In accordance with the provisions of Sec-
tion 8 of the City Charter (Chapter 10847, Laws of Florida,
1925, as amended) a nonpartisan primary election is hereby
directed to be held in the City of Miami at the polling places
designated in Exhibit No. 1 hereto on Tuesday, November 3,
1981 from 7:00 A.M. until 7:00 P.M., for the purpose of
nominating candidates for the offices of Mayor and two
Commissioners of the City of Miami to be each voted upon at
the general municipal election which is to be held, as provided
in said Section 8 of the City Charter unless in the primary
election a candidate from a group receives a majority vote in
his or her group in which case he or she shall be elected to
the office of the group for which he or she is a candidate.
Section 2. A general municipal election is hereby directed
to be held in the City of Miami at the polling places designated

in Exhibit No. 1, attached hereto and made a part hereof, from
7:00 A.M. until 7:00 P.M. on Tuesday, November 10, 1981,
for the purpose of electing a Mayor and two Commissioners
of the City of Miami unless a candidate from each group shall
have received a majority in his or her group at the nonparti—
San primary election held on November 3, 1981.
Section 3. The candidate who shall receive the highest
number of votes in Group I shall serve as Mayor for a term
of two (2) years from 12:00 o'clock Noon of the date after
the canvass of the vote and the declaration of the result of
said election; the candidates who shall receive the highest
number of votes in Groups IV and V shall serve as Commissioners
of the City of Miami for a period of four (4) years from 12:00
o'clock Noon of the day after the canvass of the vote and the
declaration of the result of said election.
Section 4. The election clerks and inspectors to serve
at said polling places on said election dates shall be those
- designated by the Supervisor of Elections for Metropolitan
Dade County for such purpose. The registration books and
records for the registration of persons qualified to vote
in said elections shall be those maintained by the Supervi—
sor of Elections for Metropolitan Dade County.
Section 5. For the purpose of enabling persons to
register who are qualified to vote in said elections, and
who have not registered under the provisions of the general
laws of Florida and Chapter lb of the Code of the City of

Miami, or who have transferred their legal residence from
one voting precinct to another voting precinct in the City,
they may register at the following permanent branch offices
as approved by the Supervisor of Elections of Metropolitan
Dade County, Florida, which are hereinafter set forth and
which will be open during the following dates and times:
ELECTIONS DEPARTMENT
1400 Biscayne Boulevard, Miami, Florida
Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M.
DADE COUNTY COURTHOUSE (LOBBY)
73 West Flagler Street, Miami, Florida
Monday to Friday, inclusive: 9:00 A.M. - 5:00 P.M.
In addition to the above times and places, said
qualified persons may register at such other branch offices
and may also use any mobile registration van for the purpose
of registration in order to vote in the herein described
elections during such times and on such dates as may be
designated by the Supervisor of Elections for Metropolitan
Dade County.
Section 6. Said elections shall be held at the voting
places in the precincts designated, all as shown on the list
attached hereto and made a part hereof and referred to as
Exhibit No. 1, or as may be designated by the Supervisor of
Elections of Dade County, in conformity with the provisions
of the general laws of the state. A description of the regis-
tration books and records which pertain to election precincts
wholly or partly within the City and which the City is adopting
and desires to use for holding such elections is as follows:

All registration cards, books, records and certificates
pertaining to electors of the City and established and
maintained as official by the Supervisor of Elections of
Dade County, in conformity with the provisions of the general
laws of the state, are hereby adopted and declared to be, and
shall hereafter be recognized and accepted as, official regis-
tration cards, books, records and certificates of the City.
Section 7. The ballot to be used in said elections shall
be so prepared that the names of the qualified candidates will
appear on said ballot in alphabetical order according to sur-
name in each group; provided, however, that the ballot and
its preparation shall comply with the laws of the State of
Florida with respect to absentee ballots, and to the use of
mechanical voting machines or the Computer Election System
(CES).
Section 8. In compliance with Florida Statute 100.342,
the City Clerk is hereby authorized and directed to publish
notice of the adoption of the herein resolution and of the
provisions hereof at least twice, once in the fifth week an
once in the third week prior to the week in which the aforesaid
nonpartisan primary election is to be held, in the following
newspapers which are published within the City of Miami,
Florida:

THE LIBERTY NEWS,
which notice shall be substantially as set forth in the
following form:

in the City of Miami, Florida, at the polling
places set forth herein, at which election the
qualified electors participating therein will
vote for the nomination of candidates for the
office of Mayor and two Commissioners of the
City of Miami, to be each voted on at the general
municipal election which is to be held on the
second Tuesday after the First Monday in November
of 1981, unless in the primary election a candidate
from a group receives a majority vote in his or her
group, in which case he or she shall be elected to
the office of the group for which he or she is a
candidate.
(b) The Election Clerks and Inspectors to serve at said
polling places on said dates shall be those designated
by the Supervisor of Elections for Metropolitan Dade
County for such purpose. The registration books and
records for the registration of persons qualified to
vote in said elections shall be those maintained by
the Supervisor of Elections for Metropolitan Dade County.
(c) The official ballot shall be in substantially the follow-

(d) In the event a general municipal election is required to
be held on Tuesday, November 10, 1981, then the official
ballot to be used at such general municipal election shall
be in substantially the same form as above, except that
the heading of the ballot shall be in substantially the
following form, to -wit:

(e) A general municipal election will be held on Tuesday,
November 10, 1981, from 7:00 A.M. until 7:00 P.M., in
the City of Miami, Florida, at the polling places
designated and set forth herein, at which election the
qualified electors of the City of Miami participating
therein will vote for the election of a Mayor and two
Commissioners of the City of Miami, Florida, unless a
candidate from each group shall have received a majority
vote in his or her group at the nonpartisan primary elec-
tion held on November 3, 1981, and the election clerks

and inspectors to serve at said polling places on
November 10, 1981 shall be those which have been
designated by the Supervisor of Elections for Metro-
politan Dade County for such purpose. The registration
books and records for the registration of persons quali-
fied to vote in said general municipal election shall
be those maintained by the Supervisor of Elections for
Metropolitan Dade County.
Section 9. RALPH G. ONGIE, City Clerk of the City of
Miami, is hereby designated and appointed as the official
representative of the Commission in all transactions with
the Supervisor of Elections of Metropolitan Dade county in
relation to matters pertaining to the use of registration
books and records for holding the herein nonpartisan primary
election and the herein general election.
The City Clerk shall cause to be prepared
absentee ballots for the use of absent electors entitled to
case such ballots in said elections.
Section 10. The City Clerk is hereby authorized and
directed to cause a certified copy of this resolution to be
delivered to the Supervisor of Elections for Metropolitan
Dade County not less than forty-five (45) days prior to the
day of the herein primary election.
