A RESOLUTION CALLING AND PROVIDING FOR A
_ SPECIAL MUNICIPAL ELECTION TO BE HELD ON
THE 3RD DAY OF NOVEMBER, 1981, FOR THE PURPOSE
OF SUBMITTING TO THE QUALIFIED ELECTORS OF
THE CITY OF MIAMI FOR THEIR APPROVAL OR DIS-
APPROVAL A PROPOSED EXTENSION AND MODIFICATION ;
OF THE EXISTING LEASE -AGREEMENT RELATED TO THE `a
OPERATION OF THE RUSTY PELICAN RESTAURANT :r
.LOCATED ON CITY -OWNED WATERFRONT PROPERTY ON
RICKENBACKER CAUSEWAY.
WHEREAS, the lessee of the city -owned Rusty Pelican Res-
taurant waterfront property on Rickenbacker Causeway has requested
an amendment to the existing lease -agreement to provide for an
additional ten (10) year extension of its lease based upon the need
to amortize an expansion and improvement program to the facility
at a proposed cost of $750,000; and
WHEREAS, under the proposed amendment, after completion
of the expansion which includes the addition of a second story res-
taurant, the minimum monthly guaranteed rent paid to the City shall
be increased from $1,500 to $4,000; and
WHEREAS, under the proposed amendment, the calculations
of monthly business -percentages rent formula shall be made separately
for the existing restaurant and the proposed new dining facility;
- and
WHEREAS, before the City agrees to the amendment sought
by the lessee of said property, it is necessary that the lease -
agreement be approved by a majority of the qualified electors of
the City of Miami voting at a special municipal election held for
the purpose of enabling said electors to register their approval or
disapproval of said amendment; and
WHEREAS, it is appropriate and necessary that the City
Commission make provision for holding said special municipal election;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF.THE
CITY OF MIAMI, FLORIDA:
Section 1. A special municipal election is hereby called
and directed to be held in the City of Miami, Florida, from 7:00 A.M.
until 7:00 P.M. on Tuesday, the 3rd day of November, 1981, for the
purpose of submitting to the qualified electors of the City of Miami
for their approval or disapproval a proposed extension and modifica-
tion of the existing lease -agreement related to the operation of the
Rusty Pelican Restaurant located on city -owned waterfront property
on Rickenbacker Causeway.
Section 2. Said special municipal election shall be held
at the voting places in the precincts designated, all as shown on
the list attached hereto and made a party hereof and referred to as

Exhibit No. 1. A description of the registration books and records
which pertain to election precincts wholly or partly within the City
and which the City is adopting and desires to use for holding such
special municipal election is as follows: All registration cards,

books, records and certificates pertaining to electors of the City
and established and maintained as official by the Supervisor of Elec-
tions of Dade County, in conformity with the provisions of the general
laws of the state, are hereby adopted and declared to be, and shall

hereafter be recognized and accepted as, official registration cards,
books, records and certificates of the City.
Section 3. For the purpose of enabling persons to register
who are qualified to vote in said election and who have not regis-
tered under the provisions of the general laws of Florida and Chapter
16 of the Code of the City of Miami, or who have transferred their
legal residence from one voting precinct to another voting precinct
in the City, they may resigter at the following permanent branch
offices as approved by the Supervisor of Elections of Metropolitan
Dade County, Florida, which are hereinafter set forth and which will
be open during the following dates and times:

In addition to the above times and places, said qualified
persons may register at such other branch offices and may also use
any mobile registration van for the purpose of registration in order
to vote in the herein described election during such times and on
such dates as may be designated by the Supervisor of Elections for
Metropolitan Dade County.

Section 5. The City Clerk of the City of Miami is hereby
desginated and appointed as the official representative of the

Commission of the City of Miami in all transactions with the Super-
visor of Elections of Dade County in relation to matters pertaining
to the use of the registration books and the holding of said election.
Section 5. The Election Clerks and Inspectors to serve
at said polling places on said date shall be designated by the Super-
visor of Elections for Metropolitan Dade County for such purpose.
Section 6. The City Clerk is hereby authorized and directed
to publish notice of the adoption of the herein resolution and of
the provisions hereof at least twice, once in the fifth week and

once in the third week prior to the week in which the aforesaid elec-

tion is to be held, in the following newspapers which are published
within the City of Miami, Florida:

Section 1. The official ballot to be used at said special
municipal election shall be in full compliance with the laws of the

State of Florida, including all provisions of the "Electronic
Voting Systems Act." The ballot used in said election for voting
on the question submitted shall be that portion of the cardboard
or paper or other material within the ballot frames of the voting
machines which will contain a statement of the question submitted,
and said voting machines shall provide facilities with such instruc-
tions on their use as will enable all qualified electors to vote for
or against such question as they may choose. Said ballot as it
appears within the first row of horizontal ballot frames of the
voting machines shall be substantially in the following form:

FOLLOWING QUESTION:
"Shall the City of Miami's lease -agreement of
city -owned Rusty Pelican Restaurant waterfront
property on Rickenbacker Causeway be amended,
conditioned upon the lessee's future expenditure
of $750,000 in construction improvements to
said property, by extending the base term of
said lease -agreement ten years and providing
for $2,500 increase in the minimum monthly
guaranteed rent and providing that calculations
of monthly business -percentage rent formula be
made separately for the existing restaurant
and the proposed new dining -facility?"
Section 8. The City Clerk shall cause to be prepared
absentee ballots in full compliance with the laws of the State of
Florida containing the question set forth in Section 7 above for
the use of absentee electors entitled to cast such ballots in said
election.
