ORDINANCE NO. 9 3 .13
AN ORDINANCE AMENbINr, SECTION 1 OF ORDINANCE NO, 9199,
ADOPTED NOVEMBER 6, 1980, TIME CITY'S CAPITAL IMPROVE-
MENT APPROPRIATIONS ORDINANCE FOR FISCAL YEAR 1980-81;
AS AMENDED; BY APPROPRIATING AN AMOUNT OF $76,200,
FROM THE FY 1981 FLORIDA POWER AND LIGHT FRANCHISE
EARNINGS TO ESTABLISH PROJECT IX.C(ii)20. FIREFIGHTING
EOUIPMENT; CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIRE-
MENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF
NO LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE
COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9199 on November
6, 1980, establishing resources and appropriations for the implementation of
capital improvements in the City of Miami, Florida, for the Fiscal Year ending
September 30, 1981; and
WHEREAS, the Department of Fire deems it of utmost necessity at this
time to replace worn and obsolete firefighting equipment; and
WHEREAS, additional unallocated FY 1981 Florida Power and Light Franchise
Earnings will be required to cover the above described expenditures;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;
Section 1. Section 1 of Ordinance No. 9199, adopted November 6, 1980,
is hereby amended in the following particulars: 1/
"Section 1. The following appropriations hereby made by fund and
project title include previously authorized projects and fund
appropriations for implementation of all municipal capital improve-
ments of the City of Miami, Florida. The sources ofrevenue to
support the herein appropriations are hereby identified by fund
and project:

Section
2. All Ordinances or parts of ordinances insofar
as they are
inconsistent

in conflict with the provisions of this ordinance
are hereby
repealed.
Section 3. If any section, part of section, paragraph, clause, phrase
or word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 4. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Commission.

"It is recommended that the attached
amendment to the Capital Improvement
Ordinance No. 9199 for emergency pur-
chase be approved; -by appropriating
$76,200 from unallocated FY 1981
Florida Power and Light Franchise
Earnings to a new Capital Improve-
ment Fund project entitled Firefighting
Equipment."
It is of utmost importance that provision be made at this time
for the replacement of worn, obsolete, and retired firefighting
equipment, such as nozzles, hose fittings, hose tools, hand
tools, rope, ladders, salvage and overhaul equipment, portable
extinguishers and breathing apparatus.
At the present time, when spare apparatus are placed into ser-
vice to substitute for front-line apparatus being repaired,
the spares must be completely outfitted (hose, tools, rope,
extinguishers, etc.) from the front-line equipment going to the
shop. This procedure results in hours of downtime for both
pieces of apparatus, whereas, the substitution should only take
minutes.
The department is also experiencing a shortage of tools used,
for forcible entry firefighting (axes, door openers, crowbars,
etc.), and power equipment used for extrication of trapped
persons (Jaws of Life, K-saws, electric smoke ejectors)..
Prior to this time, there have been no allocations made in
either the Department of Fire's General Operating Budget or the
Capital Improvement Program for purchase of these items.'

TORIAL LIMITS OF THE DOWNTOWN DEVELOPMENT DISTRICT
OF THE CITY OF MIAMI LOCATED WITHIN THE TERRITORIAL
LIMITS OF THE CITY OF MIAMI FOR THE PURPOSE OF TAXA,
TION, FIXING THE MILLAGE AND LEVYING TAXES IN THE DOWN-
TOWN DEVELOPMENT DISTRICT LOCATED WITHIN THE TER-
RITORIAL LIMITS OF THE CITY OF MIAMI, FLORIDA, FOn THE
