HomeMy WebLinkAboutO-09310F ORDINANCE NO. 9 3 1 0 AN ORDINANCE APPROVING EXPENDITURES REQUIRED BY THE DEPARTMENT OF OFF-STREET PARKING FOR THE OPERATION AND MAINTENANCE OF GUSMAN HALL AND THE OLYMPIA BUILDING OF THE CITY OF MIAMI FOR THE FISCAL YEAR COMMENCING OCTOBER 10 1981 AND ENDING SEPTEMBER 300 1982; AND ALSO APPROVING THE ENUMERATED SOURCES OF REVENUE FROM SAID OPERATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE BY FOURS -FIFTHS VOTE OF THE MEMBERS OF THE CITY COMMISSION DISPENSING WITH THE REQUIREMENT OF READING THIS ORDINANCE ON TWO SEPARATE DAYS. WHEREAS, Ordinance No. 8435 was adopted by the City Commission on July 31, 1975, authorizing the Off -Street Parking Board of the City of Miami to administer the City facility known as Gusman Hall and the Olympia Office. Building; and WHEREAS, the Off -Street Parking Board has prepared and submitted to the City Commission a separate budget estimate of the Board's expenditures and revenues for the operation and maintenance of Gusman Hall and the Olympia Bu-ilding for the fiscal year 1981 - 82; and WHEREAS, the City Commission has reviewed and approves the aforesaid separate operating budget; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAM1, FLORIDA: Section 1. The expenditures to be made by the Department of Off -Street Parking for the operation and maintenance of Gusman Hall and the Olympia Building of the City of Miami for the fiscal year ending September 30, 1982, are hereby approved together with the enumerated sources of revenue, as set forth in the attached budget forms. Section 2. The Director of the Department of Off -Street Parking is hereby authorized to make transfers between the detailed accounts comprising any of the amounts appropriated in the budget, in order that available and unrequired balances in any such accounts may be used for other necessary and proper purposes. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent with or in conflict with the provisions of this ordinance are hereby repealed, f Section 4. If any section, part of section; paragraph, clause, — phrase or word of this ordinance shall be held to be unconstitutional, or void, the remaining provisions of this ordinance shall, nevertheless, remain in full force and effect, ,t Section 5. That this ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation_ of peace, health, safety and property of the City of Miami, and upon the to further ground of necessity to make the required and necessary payments its employees and officers, payment of its contracts, payment of interest and principal on its debt, necessary and required purchases of goods and supplies and to generally. carry on the functions and duties of the Department. Section 6. That the requirement of reading this ordinance on two separate days is hereby dispensed with by a four -fifths vote of the members of the Commission. These budgets were reviewed and adopted by the Off -Street Parking Board on September 2, 1981. The required public hearing for each budget has been advertised in the Miami Herald on August 31, 1981. In discussing this with Jack Eads, the public hearing has been scheduled for September 10, 1931 at 2:30 p,m. Your assistance in ensuring that the public hearing is held as scheduled will be appreciated, This is due to the proposed implementation of a new rate schedule on October 1, 1931, which requires monthly decal customers to be notified as soon as possible.
