Home My WebLink AboutR-81-0796RESOLUTION NO. 8 1- 7 9 6 A RESOLUTION ACCEPTING THE PLAT ENTITLED TOWNPARK SUBDIVISION NO. 7, A SUBDIVISION IN THE CITY OF MIAMI; AND ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT; AND AU- THORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, the City Zoning Board and the Department of Public Works have recommended the acceptance of the Plat; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Plat entitled "TOWNPARK SUBDIVISION NO. 7", is a replat of a portion of tract 7 of Townpark Subdivision 3 U.R. Project Fla. R-10 as recorded in Plat Book 86 at Page 21. Together with: Tracts 19, 20 and 21 of Townpark Subdivision 5 U.R. Project Fla. R-10. As recorded in Plat Book 91 at Page 10, Section 36, Township 54 South, Range 41 East, all in the Public Records of the City of Miami, Dade County, Florida, which by reference is made a part hereof as it fully incorporated herein and the dedications as shown thereon together with all existing and future planting, trees and shurbbery on said property, to the perpetual use of the public, are hereby accepted and confirmed by the City of Miami, Florida Section 2. The City Manager and City Clerk are hereby au- thorized and directed to execute the Plat and record same in the Public Records of Dade County, Florida. The Proposed Record Plat entitled TOWNPARK SUBDIVISION NO. 7 is a replat of a portion of tract 7 of Townpark Subdivision No. 3 U.R. Project Fla. R-10 as recorded in Plat Book 86 at Page 21 of the Public Records of Dade County, Florida. Together with Tracts 19, 20 and 21 of Townpark Subdivision No. 5 U.R. Project Fla. R-10 as recorded in Plat Book 91 at Page 10 of the Public Records of Dade County, Florida, having a total area of 3.54+ acres. It is zoned R-4 and C-1. This plat is being forwarded to your office for City Commission Action. H. Manucy, Inc. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: (1) The property platted is a replat of a portion of tract 7 of TOWNPARK SUBDIVISION 3 U.R. PROJECT FLA. R-10 as recorded in Plat Book 86 at Page 21 of the Public Records of Dade County, Fla. Together with tracts 19, 20 and 21 of TOWNPARK SUBDIVISION 5 U.R. PROJECT FLA. R-10 as recorded in Plat Book 91 at Page 10 of the Public Records of Dade County, Fla., having a total area of 3.54± acres. It is zoned R-4 and C-1. (2) The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami, Florida. (3) As certified to by J. H. Manucy, Registered Land Surveyor, this Plat complies with the plat filing laws of the State of Florida. (4) By authority of Resolution No. ZB132-79, adopted June 4, 1979: the Plat was recommended for acceptance by the City Zbning Board of Miami. (5) The attached Certificate of Title Examination dated July 15, 1981, signed by Murray A. Greenberg, Attorney, indicates that the fee simple title to the property platted is correctly vested in Dade County and the Plat has been correctly executed. (6) The area platted is not encumbered by any mortgages. Greenberg Townpark Subdivision No. 7 Assistant County Attorney Your memorandum to this office requested an opinion of title concerning real property located in General Neighborhood Renewal Area Project Florida R-10. An application for final approval of the plat in accordance with Chapter 28 of the Metropolitan Code is being prepared. Section 28-8(d) (3) of the Metropolitan Code provides that the application for final approval must be accompanied by a "Current opinion of title from an attorney authorized to practice law in this state." In compliance with this provision of the Code, I certify that I am an attorney authorized to practice law in the State of Florida. Dade County acquired title to the subject properties either by County Eminent -Domain proceedings through final judgments on the dates indicated, by donation, or by ne- gotiated purchases as indicated on the attached listings in the three previous opinions of title attached hereto, the legal descriptions of which are set forth in the petitions filed in said cases or the deed, and are incorporated herein by reference.
