HomeMy WebLinkAboutR-81-0794RESOLUTION NO. 8 1- 7 9 4 A RESOLUTION GRANTING A SIX MONTH EXTENSION OF A CONDITIONAL USE AS LISTED IN ORDINANCE NO. 6871, ARTICLE V, SECTION 1(6) (b) TO PERMIT AN OPEN PARKING LOT FOR THE PARKING OF PRIVATE PASSENGER VEHICLES ON LOT 23; PALMHURST SUB (7-22), BEING 3024 NEW YORK STREET, AS PER SITE PLAN ON FILE, AS AN ACCESSORY USE TO THE CAR DEALERSHIP AT 3500 SOUTH DIXIE HIGHWAY AND SUBJECT TO: a. THAT THE WALL CONSTRUCTED ALONG NEW YORK STREET WILL NOT EXCEED 6' IN HEIGHT: b. THAT NEW YORK STREET WILL NOT SERVE AS AN ENTRY OR EXIT FOR TRAFFIC USING THE PARKING LOT; C. THAT CONSTRUCTION ALONG NEW YORK STREET WILL CONSIST OF A MINIMUM OFF -SET OF 20' FROM THE WEST LIMIT OR SIDE OF THE EXISTING SIDEWALK; d. THAT THE 20' OFF -SET ALONG NEW YORK STREET BE MAINTAINED ON A REGULAR BASIS AT OWNERS EXPENSE; e. THAT THE NOISE LEVEL IN THE PARKING LOT BE KEPT TO A MINIMUM AND NOT DISRUPTIVE TO RESIDENTS; f. FURTHER, MR. GENE BARRY AGREES TO CONSULT WITH NEW YORK STREET RESIDENTS AND ALLOW INPUT INTO THE TYPE OF LANDSCAPING PLANNED FOR THE 20' OFF -SET; g. THIS AGREEMENT CONSTITUTES COMPLETE UNDERSTANDING BETWEEN GENE BARRY VOLKSWAGEN, INC., AND THE RESIDENTS OF NEW YORK STREET (THE PRIMARY RESIDENTS CONCERNED); h. IN THE EVENT GENE BARRY VOLKSWAGEN, INC., WOULD BE SOLD TO ANOTHER PARTY IN THE FUTURE, THE ABOVE CONDITIONS WOULD BE A CONDITION OF THAT SALE; i. LANDSCAPING MATERIAL AND PLAN TO BE APPROVED BY THE PLANNING DEPARTMENT. ZONED R-2 (TWO FAMILY DWELLING). WHEREAS, Article XXXII of the Comprehensive Zoning Ordinance No. 6871 permits an extension of a Conditional Use by the City Manager with approval of the City Commission, for a one year period, and WHEREAS, the City Manager recommends the extension of the Conditional Use granted by Zoning Board Resolution No. Z B 25-81; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a six month extension of the Conditional Use granted from Ordinance No. 6871, Article V. Section CITY COMMISSION MEETING OF SEP2 41981 [I 1(6) (b) to permit an open parking lot for the parking of private passenger vehicles on lot 23; PALMHURST SUB (7-22), being 3024 New York Street, as per site plan on file, as an accessory use to the car dealership at 3500 South Dixie Highway and Subject to: a. That the wall constructed along New York Street will not exceed 6' in height; b. That New York Street will not serve as an entry or exit for traffic using the parking lot; C. That construction along New york Street will consist of a minimum off -set of 20' from the west limit or side of the existing sidewalk; d. That the 20' off -set along New York Street be maintained on a regular basis at owners expense; e. That the noise level in the parking lot be kept to a minimum and not disruptive to residents. f. Further, Mr. Gene Barry agrees to consult with New York Street residents and allow input into the type of landscaping planned for the 20' off -set; g. This agreement constitutes complete understanding between Gene Barry Volkswagen, Inc. and the residents of New York Street (The primary residents concerned); h. In the event Gene Barry Volkswagen, Inc. would be sold to another party in the future, the above conditions would be a condition of that sale; i. Landscaping material and plan to be approved by the Planning Department; zoned R-2 (Two -Family Dwelling), be and the same is hereby granted. PASSED AND ADOPTED this 24 day of September J. 1981. Gary Ci Manager io Per -Lu Director Planning and Zoning Boards Administration July 27, 1981 71LE .0 F3J_CT REQUEST FOR EXTENSION OF TIME CONDITIONAL USE - 3024 New York Street COMMISSION AGENDA -September 24,1981 PLANNING AND ZONING ITEMS. s ARTICLE XXXII of the Comprehensive Zoning Ordinance No. 6871 provides that any Conditional Use shall expire six months after the effective date of the Conditional Use unless a Building Permit or a Certificate of use has been issed based upon the Conditional Use. The Ordinance j further provides that the City Manager may, after review and determina- tion that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. The Planning Department finds no objection to the granting of this extension of time. We are requesting the City Attorney's office, by copy of this memo, to prepare the proper Resolution for this extension. Due to problems involved in designing and redesigning the additions to the proposed extensions :,f the existing building, it is taking longer to prepare the revised plans and let the project oli£ for bid than originally expected. Accordingly, it will be greatly appreciated if you would grant to Vorelco, Inc. an extension for one (1) year as provided for by law, according to the letter of the Department of Administration, Planning and Zoning Boards dated March 101 1981.
