A RESOLUTION GRANTING A NINE MONTH EXTENSION OF
A VARIANCE GRANTED FROM ORDINANCE NO. 6871,
ARTICLE XI-2, SECTION 5 AND ARTICLE XXIII,
SECTION 4(2) (a), TO PERMIT A 129-UNIT APART-
MENT STRUCTURE ON THAT PORTION OF LOTS 14 AND
15; BLOCK 104S; BRICKELL'S ADDITION AMENDED
(B-113) LYING SOUTHEASTERLY OF THE SOUTHEASTERLY
RIGHT-OF-WAY LINE OF S.E. BAYSHORE DRIVE AND
THAT PORTION OF UNPLATTED LAND LYING SOUTH-
EASTERLY OF SAID LOTS TO THE SHORELINE BEING
APPROXIMATELY 1005 S. E. BAYSHORE DRIVE AS
PER PLANS ON FILE WITH A 3.52 PROPOSED FLOOR
AREA RATIO (F.A.R.) (2.52 F.A.R. WITH BONUSES
RECOMMENDED BY THE URBAN DEVELOPMENT REVIEW
BOARD (UDRB); ALSO, PROVIDING 221 OF 227
REQUIRED OFF-STREET PARKING SPACES AND SUBJECT
TO PLATTING; ZONED R-CB (RESIDENTIAL OFFICE).
THIS PETITION IN CONJUNCTION WITH AN APPLICktION
FOR SITTING ADJUSTMENT AS RECOMMENDED BY THE
URBAN DEVELOPMENT REVIEW BOARD.
WHEREAS, Article XXXI of Ordinance No 6871, the
Comprehensive Zoning Ordinance for the City of Miami, permits an
extension of a variance by the City Manager, with approval of
the City Commission for a one year period; and
WHEREAS, the City Manager recommends the extension of
the variancesgranted by Zoning Board Resolutions ZB-42-81 and
ZB-43-81;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The request for a 9 month extension of the
variances granted from Ordinance No. 6871, Article XI-2, Section 5
and Article XXIII, Section 4(2)(a), to permit a 129-Unit apartment
structure on that portion of lots 14 and 15; Block 104S; Brickell's
Addition amended (B-113) lying southeasterly of the southeasterly
right-of-way line of S. E. Bayshore Drive and that portion of un-
platted land lying southeasterly of said lots to the shoreline
being approximately 1005 S. E. Bayshore Drive, as per plans on file,
with a 3.52 proposed floor area ratio (F.A.R.) (2.52. F.A.R. with
bonuses recommended by the Urban Development Review Board (UDRB)

also, providing 221 of 227 required off-street parking spaces
and subject to platting; zoned R-CB (Residential Office). This
Petition in conjunction with an application for sitting adjustment
as recommended by the Urban Development Review Board, be and the
same are hereby granted.

concurs with the recommendations of the Urban
Development Review Board on the bonuses, siting
adjustment and parking waiver. No hardship exists
to justify the additional floor area ratio as a
reasonable use in being provided under the terms
of the subject request and the zoning ordinance.
PUBLIC WORKS Needs to be platted. No dedication is requested.

ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides that
any Variance shall expire six months after the effective date of the Vari-
ance unless a Building Permit or a Certificate of Use has been issued
based upon the Variance. The Ordinance further provides that the City
Manager may, after review and determination that substantial progress has
been achieved by the applicant in terms of project pltnning, extend the
expiration date of the Variance for an additional period of time not to
exceed one year, subject to approval of the City Commission.
The Planning Department finds no objection to the granting of the extension
of time for this Variance.
We are requesting the City Attorney's office, by copy of this memo, to
prepare the proper Resolution for this extension.

This letter serves as our application for an
extension
_
of time
on variances No.
ZB-42-81 and No. ZB-43-81
pursuant to
Article
XXXI, Section 3,
and Article IV, Section 5,
City of
Miami Zoning Code.
The applicant, South Bayshore Development, has made
substantial progress in the planning of its project, "The Re-
naissance". It has, at this time, completed the platting proce-
dure with the City of Miami and is awaiting the recordation of
the final plat in the records of Dade County. It is also progres-
sing in gaining the necessary permits from local, county, state
and federal agencies in order to construct the bulkhead on the
site. At present, it has obtained Permit No. 221 issued by the
City of Miami Public Works Department. Permit applications for
bulkhead construction have been filed and granted by the State
of Florida Department of Environmental Regulation for that same
bulkhead and Corps of Engineers and Dade County approval is
pending.

ready to begin construction within the time limits of our
