AN ORDINANCE AMENDING SECTION 18=5 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED: "FEES FOR OPENING AND
CLOSING GRAVES AT CITY --OWNED CEMETERY";
BY ESTABLISHING A NEW SCHEDULE OF FEES;
CONTAINING A REPEALER PROVISION AND A
SEV ERABILITY CLAUSE; AND DISPENSING WITH
THE REQUIREMENT OF READING SAME ON TWO
SEPARATE DAYS BY A VOTE OF NOT LESS THAN
FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION.
WHEREAS, the present fees for opening and closing graves at the
City Cemetery are below comparable rates of commercial cemeteries; and
WHEREAS, the fees for opening and closing graves at the City
Cemetery have not been increased since 1968; and
WHEREAS, the labor and equipment costs to the Parks Department
Operations Division have increased since 1968 and are presently in excess

of the fees presently charged;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. Section 18-5 of the Code of the City of Miami, Florida,
as amended, is hereby amended in the following particulars: 1/
"Sec. 18-5. Fees for opening and closing graves at city -owned cemetery.
(a) Generally. The schedule of fees for opening and closing graves
at the city -owned cemetery is as follows:

(b) Veterans, The fees for war veterans interred in Block 35
and a portion of Block 42 and the north and south peripheral area of
the city cemetery shall be rediaeed as follows:
Opening and closing of a grave where casket at outer case is:

Double depth (to permit burial
of wife in same gravesite) 75r99 150. 00
Fees for veterans interred in other sections of the city cemetery than
those delineated above shall remain the same as heretofore established. "
Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent with or in conflict with the provisions of this ordinance are
hereby repealed.
Section 3. if any section, part of section, paragraph, clause, phrase
or word of this ordinance shall be held to be unconstitutional or invalid, the
remaining provisions of this ordinance shall not be affected.
Section 4. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Comrrnission.

Opening and Closing Graves
at the City -Owned Cemetery
For City Commission Ivieeting
of September 10, 1981

It is recommended that the City Code
be amended to establish a new schedule
of fees for opening and closing graves
at the City -owned cemetery, per the
attached ordinance.
The attached ordinance sets forth an increased schedule of
fees for burials at the City Cemetery. Inasmuch as Cemetery
fees have not been adjusted since 1968 and costs to the City
have risen considerably in the last 13 years, the Parks
Department recommends the increase. The proposed rates
are in line with those of other area cemeteries. If adopted
these fees would result in an increase in revenue of $2, 205
for the same number of burials as in prior years.
