HomeMy WebLinkAboutO-09319AMENDMENT NO, TO ORDINANCE NO, 97.90 ORDINANCE NO, AN ORDINANCE AMENnING SECTION 1 OF ORDINANCE NO, 9199, THt'CITY'S CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE FOR FISCAL YEAR 1980-81; AS AMENDED, BY INCREASING THE AP-: PR.OPRIATION FOR SUBSECTION XV., PARKING CAPITAL PROJECTS FUND, (ITEM C,l,) IN THE AMOUNT OF $40,000 FROM A LOAN FROM THE CAPITAL IMPROVE- MENT FUND, FY 1981 FLORIDA POWER AND LIGHT FRANCHISE REVENUES FOR. LAND APPRAISALS FOR THE CORE AREA WEST PARKING FACILITY; CONTAINING A REPEALER PROVISION AND A SEVERABI- LITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 9199 on November G, 1980, establishing resources and appropria- tions for the implementation of capital improvements in the City of Miami, Florida, for the Fiscal Year ending Septem- ber 30, 1981; and WHEREAS, by adoption of Resolution 80-819, dated November G, 1980, and Resolution 80-361, dated November 26, 1980, the City.Commission authorized the City Manager to initiate a study to investigate the public need for parking in the portion of the Central Business District designated as Core Area Nest and to determine the economic feasibility of developing a multi -story public parking facility;.i►.nd WHEREAS, the selected professional consulting firm, Kimley-Horn and Associates, Inc., has investigated the parking requirements and needs and.has determined the eco- nomics of undertaking development of a parking facility; and WHEREAS, the consultants have found that there is an existing deficiency in parking spaces and that there will be a continual increase in the parking deficiency in Core Area West, such that a need for public parking is established; and WHEREAS, the consultants have prepared a final draft.re- port, which was accepted in principle,by City Commission Re-, solution 81-759, dated Septebmer 10 1981; and a WHtREAS, the City ComMission,in Motion 81400, dated September 10, 1981, directed the City Manager to proceed with the appraisal of land in Core Area West; and WHERtAS, the cost of the,appraisal will be $40,000; and WHEREAS, $ 40,000 is available for the aforemen- tioned purpose as a loan from FY 1981 Florida Power and Light Franchise revenues; and WHEREAS, funds in the amount of $ 40,000 will be available from the anticipated Core Area `best parking fa- cility revenue bonds upon sale of said bonds for the re- payment of funds to the proceeds of the Interama Land Sale Fund; NOW, THEREFORE, BE IT,ORDAINED BY THE COMMISSION.OF THE CITY OF t.IIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 9199, adopted November G, 1980, the City's Capital Improvement Appro- priations Ordinance for Fiscal Year 1980-81, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The following appropriations hereby made by fund and project title include previously author- .ized projects and fund appropriations for implementation of all municipal capital improvements of the City of Miami, Florida. The sources of revenue to support the herein appropriations are hereby identified by fund and project: Xv. Core Area West Parking - Garage -3A:9 707.01I — TOTAL APPROPRIATED 346-9 35 Section 2, repayment of the above -mentioned loan, in - eluding interest computed at the average prevailing rate for the loan period, will be made to the FY 1951 Florida Power and Light Franchise revenues in the Capital Improvement Fund upon the sale of the Core Area West parking facility revenue bonds, Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions - of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected'. Section 5. The requirement of reading this ordinance on two = separate days is hereby dispensed with by a vote of not less ,than four -fifths of the members of the Commission. Morris i Kaufmann FILE sUaJECT Proposed. ordinance for City E=e!l ^'n M6gz+-1' tirt G�r'llrmrlili C-A It is recommended that the proposed Ordinance be adopted by the City Commission at its meeting scheduled for September 24; 1981, The ordinance provides for a. transfer of funds from the Capital Improvement Fund, FY, 1981,,Florida Power and Light Franchise Revenues, on a loan basis to the Parking Capital Projects Fund, for Cote Area West, for the purpose of appraising land. In the City Commission meeting of September 10, 1981, the City Commission adopted Resolution No. 81-759, accepting in principle a final draft report, prepared by Kimley-Horn and Associates, Inc. The report indicated that there was a public need for parking in'that portion of the Central Business, District designated as Core Area West. The City Commission also passed Motion No. 81-760, directing the City Manager to proceed immediately with, two appraisals of land in Core Area West, none of which shall exceed $20,000. The proposed ordinance provides funds for the appraisals by transferring funds from the Capital Improvement Fund FY 1981, FPL Franchise Revenues to the Parking Capital Parking Fund, Core Area West project.
