Y RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO UNITED SERVICES AUTOtdO= BILE ASSOCIATION, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $7,897.12 IN FULL AND COMPLETE SETTLEMENT OF ITS PRO- PERTY DAMAGE, SUBROGATION CLAIMS AND ALL OTHER CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, AND UPON THE EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. i. WHEREAS, United Services Automobile Association has filed a claim against the City of Miami for its property damage sub- rogation resulting from an accident involving a City owned vehicle on June 19, 1980 at or near the intersection of North- west 12th Avenue and Northwest 16th Street, Miami, Dade County, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's Office in accordance with Ordinance #8417, which creates the City of Miami's Self Insurance Program and said Office recommends that this claim be settled for the sum of $7,897.12; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The cause of this vehicle accident was that a City of. Miami public maintenance vehicle rear.ended a 1973 P-lercedes Benz, 450SLC, 2 door, owned aqd driven by Leonard Sommers, M.D. A line of traffic had stopped Thasrityevehicle strucksult of the the ahead making a right turn. e Sommers' vehicle causing it to proceed forward into the rearend of another vehicle. Considerable damage resulted to the front end and rearenc of tile vehicle. Subsequently, United Services Automobile Association, handled the collision loss with Dr. Sommel_s. �r.aiser valued tine vehicle in excess of $12,000.00 Pre- vious apious to the accident. The cost of repair was $7,997.12, in- cluding a $100.00 deductible. The amount of $7,897.12 is requested to conclude the collision subrogation claim. The bodily injury and collision deductible amount have been settled earlier for an amount that did not require City Commission approval.
